Hearing.  The Texas Health and Human Services Commission (HHSC) will conduct a public hearing on August 7, 2014, at 8:00 a.m. to receive public comment on proposed base rate increases for attendant services provided under the following programs operated by the Department of Aging and Disability Services (DADS): Primary Home Care; Community Attendant Services; Family Care; Community Based Alternatives – Home and Community Support Services; Residential Care; Day Activity and Health Services; Medically Dependent Children Program; and Consumer Directed Services. Hearing.  The Texas Health and Human Services Commission (HHSC) will conduct a public hearing on Thursday, August 7, 2014, at 9 a.m. to receive public comment on Nursing Facility and Hospice-NF Medicaid payment rates.  The hearing will be held in compliance with Human Resources Code §32.0282; Title 1 of the Texas Administrative Code ("TAC"), Part 15, Chapter 355, Subchapter B, §355.201 (relating to Establishment and Adjustment of Reimbursement Rates by the Health and Human Services Commission); and Title 1 of the TAC, Part 15, Chapter 355, Subchapter A, §355.105(g) (relating to General Reporting and Documentation Requirements, Methods and Procedures), which require public notice and a hearing on proposed Medicaid reimbursements.  Proposal.  HHSC proposes to increase NF and Hospice-NF payment rates by six percent as compared to rates in effect on August 31, 2013.  The proposed new rates will be effective September 1, 2014, and were determined in accordance with the rate setting methodologies listed below under “Methodology and Justification.” Methodology and Justification.  The proposed Medicaid payment rates incorporate appropriations provisions from the 2014-15 General Appropriations Act, S.B. 1, 83rd Legislature Regular Session, 2013 (Article II, Department of Aging and Disability Services, Rider 40), which appropriated funds to provide for a six percent increase for NF and Hospice-NF payment rates, calculated based on the rates in effect on August 31, 2013. HHSC’s proposed payment rates were calculated in accordance with the rate setting methodology in Title 1 of the TAC, Part 15, Chapter 355, Subchapter C, §355.307 (relating to Reimbursement Setting Methodology); §355.308 (relating to Direct Care Staff Rate Component); and §355.312 (relating to Reimbursement Setting Methodology – Liability Insurance Costs). Announcement of SB1542 Sub-committee Clinical Suggestions for Submission, Michael Vaclav, DDS. INFORMATIONAL ITEMS: 6. Amendments and Clarifications to Texas Healthcare Transformation and Quality Improvement Program (THTQIP) Rules Assistants. HHSC proposes amendments to §354.1602, 354.1612, 354.1622, 354.1633, and 354.1634 concerning THTQIP and new §354.1623, 354.1624, 354.1635, 354.1636, and 354.1637 concerning the Delivery System Reform Incentive Payment Program (DSRIP). HHSC also proposes to repeal existing §354.1635 concerning Regional Healthcare Partnership (RHP) Plan Modification. There are four major amendments to the THTQIP rules. First, the process for RHP plan modifications is clarified and moved to Division 3, concerning RHP Plan Contents and Approval. Second, the roles and responsibilities of the Independent Assessor are described. The Independent Assessor will conduct the mid-point assessment and ongoing compliance monitoring of DSRIP projects. Third, the amendments include the final form and valuation methodology for Category 3 DSRIP outcomes. Fourth, the amendments include a description of the effect of DSRIP project termination on previous DSRIP payments. The DSRIP program rules are largely meant to mirror the requirements of the Program Funding and Mechanics (PFM) Protocol. The PFM Protocol is a document written jointly by HHSC and Centers for Medicaid and Medicare Services that represents agreements between the two concerning the operation of the DSRIP program -Lisa Kirsch, HHSC. 7. Federally-required changes to presumptive eligibility for Medicaid. HHSC proposes two amendments and new rules for 1 Texas Administrative Code (TAC) Chapter 366 that provide the eligibility requirements for individuals to qualify for presumptive eligibility, the requirements for providers making presumptive eligibility determinations, and HHSC responsibilities for oversight of providers making presumptive eligibility determinations.  In order to align policies and procedures, HHSC is also amending existing rules for qualified entities making presumptive eligibility determinations for pregnant women. Gina Perez, HHSC Disproportionate Share Hospital Reimbursement Methodology, Waiver Payments HHSC proposes to amend Title 1, Part 15, Chapter 355, §355.8065, concerning Disproportionate Share Hospital Reimbursement Methodology; §355.8201, Waiver Payments to Hospitals for Uncompensated Care; §355.8202, Waiver Payments to Physician Group Practices for Uncompensated Care; and §355.8441, Reimbursement Methodologies for Early and Periodic Screening, Diagnosis, and Treatment. The proposed amendments are intended to meet the requirements of 2014-15 General Appropriations Act, Senate Bill 1, 83rd Legislature, Regular Session, 2013 (Article II, Health and Human Services Commission, Rider 86, Transitional Medicaid disproportionate share hospital and Related Payments), which allows HHSC to expend up to $160 million in general revenue funds in fiscal year (FY) 2014 and $140 million in general revenue funds in FY 2015 to stabilize and improve Medicaid hospital payments.  Changes are proposed to both the disproportionate share hospital and uncompensated care (UC) supplemental payment programs. The proposed amendments to the disproportionate share hospital and UC supplemental payment program revise the way that the state's disproportionate share hospital allocation is distributed among eligible hospitals and the way that the state's UC allocation is distributed among eligible provider. – Pam McDonald, HHSC. 9. Minimum Nursing Facility Payments for Non-State Government-Owned Nursing Facilities. HHSC proposes new §353.608, concerning Payments to Qualified Nursing Facilities, to maintain a certain level of funding for non-state government-owned nursing facilities through the creation of a new funding program. The proposed rule is intended to continue a similar level of funding to the nursing facility upper payment limit program participants, as outlined in 1 TAC §355.314 adopted in 2012, but through a new means.  Beginning March 1, 2015, Nursing Facilities (NF) services will be "carved-in" to managed care.  At that time, the capitated payment HHSC makes to Medicaid managed care organizations (MCOs) will include funds for NF services provided by NFs contracted with the MCOs. As a result of the carve-in, HHSC is prohibited from continuing the NF Upper Payment Limit program. MCOs will now make a minimum payment to eligible NFs. – Pam McDonald, HHSC. NOTICE OF PROPOSED RULES/ACTION ITEMS: 10. Payment to Advanced Practice Registered Nurses (APRN) and Physician Assistants (PA). HHSC proposes amendments to Title 1, Part 15, Chapter 354, Subchapter A, Division 1, Rule §354.1001, Claim Information Requirements, and Division 5, Rule §354.1062, Authorized Physician Services. HHSC is proposing to amend §354.1001 to require a physician billing for supervised services to indicate that the supervised services were performed by an APRN or PA, as appropriate, on the physician's claim form.  HHSC is also proposing to amend §354.1062 to clarify that the payment rate for the supervised services is set in accordance with the appropriate reimbursement rule.  Finally, these rule changes are coordinated with proposed clarifications to the corresponding reimbursement rules in chapter 355 for PAs, nurse practitioners, clinical nurse specialists, certified registered nurse anesthetists, and certified nurse-midwives.  Those proposed changes clarify that services performed by one of the above provider types while under the supervision of a physician are to be reimbursed at the 92 percent level appropriate to the supervised practitioner.        – Laurie Vanhoose, HHSC. 11. Reimbursement Methodology for Physician Assistants, Nurse Practitioners, Clinical Nurse Specialists, and Midwife Services . HHSC proposes to amend Title 1, Part 15, Chapter 355, Subchapter J, §355.8093, Physician Assistants, §355.8161, Reimbursement Methodology for Midwife Services, and §355.8281, Reimbursement Methodology.  The proposed amendments will update the Medicaid reimbursement methodology to more accurately reflect the reimbursement methodology for physician assistants, certified nurse midwives, nurse practitioners, and clinical nurse specialists by standardizing rule titles, deleting obsolete language, and restructuring rule layout.         -Tim Villasana, HHSC. 12. Medical Records Fees.  Amendment to:  Title 1, Part 15, Chapter 354, Subchapter A, Division 1, §354.1005, Unauthorized Charges. HHSC proposes to amend §354.1005, Unauthorized Charges, under Title 1, Part 15, Chapter 354, Subchapter A, Division 1, to clarify that a Medicaid provider may not charge a Medicaid recipient for any function incidental to the provision of a covered service, including the completion of a health assessment form or for a copy of a medical record, unless otherwise provided in the rule.        – Laurie Vanhoose, HHSC. 13. Recommendation to propose amendments to 40 TAC§30.14, Certification of Terminal Illness, in Chapter 30, Medicaid Hospice Program. HHSC, on behalf of the Department of Aging and Disabilities Services (DADS), proposes to amend rules to align with federal requirements regarding the certification of terminal illness and maintenance of records. – Cynthia De La Cruz, DADS. 14. Repeal of Chapter 100. HHSC, on behalf of DADS, proposes the repeal of all rules in Chapter 100 which describe responsibilities of the former Texas Department of Mental Health and Mental Retardation regarding fraud and abuse and recovery of benefits, internal audits and investigations, and the intermediate care facility for individuals with an intellectual disability dental program. Rules regarding these topics are now covered under other titles in the TAC or in the Texas Internal Auditing Act (Government Code, Title 10, Subtitle C, Chapter 2102, Internal Auditing) therefore DADS has determined that Chapter 100 is no longer necessary. Determine whether there are additional changes necessary to ensure that the Board is able to regulate the practice of dentistry and ensure public safety. ·Cancer Prevention and Research Institute: Monitor implementation of initiatives aimed at restructuring the governance structure, eliminating conflicts of interest, and increasing transparency at the Cancer Prevention and Research Institute of Texas (CPRIT). Charge #4 – Identify cost-effective alternatives to Medicaid and the Affordable Care Act to better connect low income individuals to health care services through private market-based solutions, including Medicaid block grants and waivers. Recommendations should strive to encourage cost sharing, promote personal responsibility, reduce uncompensated care costs, contain increasing health care costs, improve access to care, address access to emergency department care issues in rural areas, promote the use of existing private coverage or employee sponsored coverage, reduce non-emergency use of emergency departments, and reduce the need for federal approval to the state Medicaid plan. Proposed Medicaid Payment Rates for Small and Large, State-Operated Intermediate Care Facilities for Individuals with an Intellectual Disability. Hearing.  Health and Human Services Commission (HHSC) will conduct a public hearing on August 15, 2014, at 1 p.m. to receive public comment on the proposed interim per diem Medicaid reimbursement rates for small and large, state-operated Intermediate Care Facilities for Individuals with an Intellectual Disability (ICF/IID) operated by the Department of Aging and Disability Services (DADS).  The hearing will be held in compliance with Texas Human Resources Code §32.0282 and Texas Administrative Code (TAC) Title 1, §355.105(g), which require that public hearings be held on proposed reimbursement rates before such rates are approved by HHSC.  Proposal.  As the single state agency for the state Medicaid program, HHSC proposes the following interim per diem reimbursement rates for small and large, state-operated ICF/IIDs  operated by DADS, to be effective September 1, 2014: Small State-Operated ICF/IID Facilities Proposed interim daily rate:  $644.17. Large State-Operated ICF/IID Facilities – Medicaid Only clients Proposed interim daily rate:  $770.11.
