First, the process for RHP plan modifications is clarified and moved to Division 3, concerning RHP Plan Contents and Approval. Second, the roles and responsibilities of the Independent Assessor are described. The Independent Assessor will conduct the mid-point assessment and ongoing compliance monitoring of DSRIP projects. Third, the amendments include the final form and valuation methodology for Category 3 DSRIP outcomes. Fourth, the amendments include a description of the effect of DSRIP project termination on previous DSRIP payments. The DSRIP program rules are largely meant to mirror the requirements of the Program Funding and Mechanics (PFM) Protocol. The PFM Protocol is a document written jointly by HHSC and CMS that represents agreements between the two concerning the operation of the DSRIP program. -Lisa Kirsch, HHSC 7. Federally-required changes to presumptive eligibility for Medicaid HHSC proposes two amendments and new rules for 1 TAC Chapter 366 that provide the eligibility requirements for individuals to qualify for presumptive eligibility, the requirements for providers making presumptive eligibility determinations, and HHSC responsibilities for oversight of providers making presumptive eligibility determinations. In order to align policies and procedures, HHSC is also amending existing rules for qualified entities making presumptive eligibility determinations for pregnant women. – Gina Perez, HHSC 8. Disproportionate Share Hospital Reimbursement Methodology, Waiver Payments HHSC proposes to amend Title 1, Part 15, Chapter 355, s355.8065, concerning Disproportionate Share Hospital Reimbursement Methodology; s355.8201, Waiver Payments to Hospitals for Uncompensated Care; s355.8202, Waiver Payments to Physician Group Practices for Uncompensated Care; and s355.8441, Reimbursement Methodologies for Early and Periodic Screening, Diagnosis, and Treatment (EPSDT). The proposed amendments are intended to meet the requirements of 2014-15 General Appropriations Act, S.B. 1, 83rd Legislature, Regular Session, 2013 (Article II, Health and Human Services Commission, Rider 86, Transitional Medicaid DSH and Related Payments), which allows HHSC to expend up to $160 million in general revenue funds in fiscal year (FY) 2014 and $140 million in general revenue funds in FY 2015 to stabilize and improve Medicaid hospital payments. Changes are proposed to both the disproportionate share hospital (DSH) and uncompensated care (UC) supplemental payment programs. The proposed amendments to the DSH and UC supplemental payment program revise the way that the state's DSH allocation is distributed among eligible hospitals and the way that the state's UC allocation is distributed among eligible provider. – Pam McDonald, HHSC 9. Minimum Nursing Facility Payments for Non-State Government-Owned Nursing Facilities The Texas Health and Human Services Commission (HHSC) proposes new s353.608, concerning Payments to Qualified Nursing Facilities, to maintain a certain level of funding for non-state government-owned nursing facilities through the creation of a new funding program. The proposed rule is intended to continue a similar level of funding to the nursing facility upper payment limit program participants, as outlined in 1 TAC s355.314 adopted in 2012, but through a new means. Beginning March 1, 2015, Nursing Facilities (NF) services will be "carved-in" to managed care. At that time, the capitated payment HHSC makes to Medicaid managed care organizations (MCOs) will include funds for NF services provided by NFs contracted with the MCOs. As a result of the carve-in, HHSC is prohibited from continuing the NF Upper Payment Limit program. MCOs will now make a minimum payment to eligible NFs. – Pam McDonald, HHSC notice of proposed rules/action items: 10. Payment to Advanced Practice Registered Nurses (APRN) and Physician Assistants (PA) HHSC proposes amendments to Title 1, Part 15, Chapter 354, Subchapter A, Division 1, Rule s354.1001, Claim Information Requirements, and Division 5, Rule s354.1062, Authorized Physician Services. HHSC is proposing to amend s354.1001 to require a physician billing for supervised services to indicate that the supervised services were performed by an APRN or PA, as appropriate, on the physician's claim form. HHSC is also proposing to amend s354.1062 to clarify that the payment rate for the supervised services is set in accordance with the appropriate reimbursement rule. Finally, these rule changes are coordinated with proposed clarifications to the corresponding reimbursement rules in chapter 355 for PAs, NPs, CNSs, CRNAs, and CNMs. Those proposed changes clarify that services performed by one of the above provider types while under the supervision of a physician are to be reimbursed at the 92 percent level appropriate to the supervised practitioner. – Laurie Vanhoose, HHSC 11. Reimbursement Methodology for Physician Assistants, Nurse Practitioners, Clinical Nurse Specialists, and Midwife Services HHSC proposes to amend Title 1, Part 15, Chapter 355, Subchapter J, s355.8093, Physician Assistants, s355.8161, Reimbursement Methodology for Midwife Services, and s355.8281, Reimbursement Methodology. The proposed amendments will update the Medicaid reimbursement methodology to more accurately reflect the reimbursement methodology for physician assistants, certified nurse midwives, nurse practitioners, and clinical nurse specialists by standardizing rule titles, deleting obsolete language, and restructuring rule layout. -Tim Villasana, HHSC 12. Medical Records Fees. Amendment to: Title 1, Part 15, Chapter 354, Subchapter A, Division 1, s354.1005, Unauthorized Charges HHSC proposes to amend s354.1005, Unauthorized Charges, under Title 1, Part 15, Chapter 354, Subchapter A, Division 1, to clarify that a Medicaid provider may not charge a Medicaid recipient for any function incidental to the provision of a covered service, including the completion of a health assessment form or for a copy of a medical record, unless otherwise provided in the rule. – Laurie Vanhoose, HHSC 13. Recommendation to propose amendments to 40 TAC s30.14, Certification of Terminal Illness, in Chapter 30, Medicaid Hospice Program. HHSC, on behalf of the Department of Aging and Disabilities Services (DADS), proposes to amend rules to align with federal requirements regarding the certification of terminal illness and maintenance of records. – Cynthia De La Cruz, DADS 14. Repeal of Chapter 100 HHSC, on behalf of the Department of Aging and Disabilities Services (DADS), proposes the repeal of all rules in Chapter 100 which describe responsibilities of the former Texas Department of Mental Health and Mental Retardation regarding fraud and abuse and recovery of benefits, internal audits and investigations, and the intermediate care facility for individuals with an intellectual disability dental program. Charge #4 – Identify cost-effective alternatives to Medicaid and the Affordable Care Act to better connect low income individuals to health care services through private market-based solutions, including Medicaid block grants and waivers.
