Proposed New Rule Concerning The Electronic Visit Verification System. Texas Health and Human Services Commission (HHSC) will conduct a public hearing to receive comments on the proposed new rule to Title 1, Part 15, Chapter 354, Subchapter A, Division 11, §354.1177, concerning Electronic Visit Verification (EVV) System.  The proposed new rule establishes requirements applicable to contractors providing EVV services for Medicaid-enrolled providers and guidelines for Medicaid-enrolled providers that are required to use an EVV system for services as defined by HHSC.  Additionally, the rule defines which Medicaid services require EVV and identifies the data elements that must be included to verify the service occurred. Proposed payment rates for the Community Based Alternatives (CBA) – Home and Community Support Services waiver and associated Consumer Directed Services (CDS) programs.  These programs are operated by the Department of Aging and Disability Services (DADS). The payment rates are proposed to be effective March 1, 2014.  The public hearing will be held in compliance with Human Resources Code §32.0282 and Title 1 of the Texas Administrative Code (TAC) §355.105(g), which require public notice and hearings on proposed reimbursement rates. Proposal.  HHSC proposes rate increases for CBA – Home and Community Support Services Personal Attendant Services (PAS) and associated CDS rates(s).  The proposed rates will be effective March 1, 2014, and were determined in accordance with the rate setting methodologies listed below under “Methodology and Justification.” Methodology and justification.  Effective September 1, 2013, DADS amended Title 40, TAC, Chapter 49, Contracting for Community Care Services, and HHSC amended its managed care contracts to incorporate a minimum wage requirement of $7.50 per hour for personal attendants (to increase to $7.86 effective September 1, 2014).  These changes were made in response to the 2014-15 General Appropriations Act (Article II, Special Provisions, Section 61, Senate Bill 1, 83rd Legislature, Regular Session, 2013) which indicated that appropriations made elsewhere in the Act included funds for an increase in the base wage of personal attendants to $7.50 an hour in fiscal year 2014 and $7.86 an hour in fiscal year 2015.  HHSC proposes to increase the attendant compensation rate component for nonparticipating and participating contracts in the Attendant Compensation Rate Enhancement for the CBA – Home and Community Support Services program and associated rate(s) in the CDS program to support the required minimum wage.  The proposed rates were determined in accordance with the rate setting methodologies codified at Title 1, TAC, Chapter 355, Subchapter C, §355.503, Reimbursement Methodology for the CBA Waiver Program and the Integrated Care Management – Home and Community Support Services and Assisted Living/Residential Care Program, Subchapter A, §355.112, Attendant Compensation Rate Enhancement and §355.114, Consumer Directed Services Payment Option.  These rates were subsequently adjusted in accordance with 1 TAC Chapter 355, Subchapter A, §355.101, Introduction, and §355.109, Adjusting Reimbursement When New Legislation, Regulations or Economic Factors Affect Costs, and Subchapter B, §355.201, Establishment and Adjustment of Reimbursement Rates by HHSC. Hospital-Specific Methodology HHSC is amending 1 Texas Administrative Code (TAC) s355.8066, concerning Hospital-Specific Limit Methodology. This proposal amends the methodology used to calculate a hospital-specific limit (HSL) for each Medicaid hospital participating in either the Disproportionate Share Hospital program, described in s355.8065, or in the Texas Healthcare Transformation and Quality Improvement Program, described in s355.8201. The HSL is the maximum payment amount that a hospital may receive in reimbursement for the cost of providing Medicaid-allowable services to individuals who are Medicaid eligible or uninsured to cover costs that are not reimbursed by Medicaid or other payment sources. The proposal brings the rule into compliance with Section 32.0284 of the Human Resources Code which states "For purposes of calculating the hospital-specific limit used to determine a hospital's uncompensated care payment under a supplemental hospital payment program, the commission shall ensure that to the extent a third-party commercial payment exceeds the Medicaid allowable cost for a service provided to a recipient and for which reimbursement was not paid under the medical assistance program, the payment is not considered a medical assistance payment." -Pam McDonald, HHSC 5. Medicaid for Transitioning Foster Care Youth HHSC is amending 1 TAC s366.611, effective January 1, 2014, to provide Medicaid coverage only to youth who transition out of foster care in Texas. The amendment also includes language to ensure that former foster youth from any state who were receiving Medicaid services in Texas on or before December 31, 2013, will continue to be eligible for services, subject to other conditions of eligibility. -Stephanie Stephens, HHSC 6. Attendant Compensation Rate Enhancement HHSC proposes to amend 1 TAC s355.112 to delete obsolete language regarding reinvestment of recouped funds to improve the clarity of the rule and add new language describing the process whereby the Department of Aging and Disability Services (DADS) recoups from Home and Community-based (HCS) and Texas Home Living (TxHmL) providers when the providers are out of compliance with program rules and places a vendor hold on those providers who do not timely submit the required repayment. -Doug Odle, HHSC 13. Inpatient Hospital Reimbursement HHSC proposes to amend 1 TAC s355.8052, concerning Inpatient Hospital Reimbursement, to address a drafting error in the publication of the adopted rule describing the methodology used to calculate final full-cost standard dollar amounts to avoid erroneous payments to children's and rural hospitals. The proposed changes conform to HHSC's calculation of inpatient hospital reimbursement rates. HHSC also proposes to revise the methodology used to calculate the inpatient reimbursement rate assigned to new rural hospitals. -Laura Skaggs, HHSC 14. Community Service Contracts HHSC, on behalf of the Department of Aging and Disabilities Services (DADS), proposes to repeal and add new sections to 40 TAC to provide the basis for contracting with DADS to provide community-based services. The new chapter clarifies and revises requirements for obtaining, maintaining, and terminating such contracts. Consumer-Directed Services HHSC, on behalf of DADS, proposes new sections, repeals, and amendments to 40 TAC, Chapter 41 address assurances set forth in the s1915(c) waiver applications about health and safety and qualified providers as those assurances relate to the consumer directed services (CDS) option; conform to the changes resulting from the proposed new Chapter 49 in Chapter 41 that are addressed in Chapter 49, Contracting for Community Services; state DADS current service delivery expectations of a CDS employer; describe the requirements of a CDS employer receiving nursing tasks; require the CDS employer to enter into an agreement with the FMSA that contains all of the requirements specific to the individual's program regarding service delivery, documentation, and provider qualifications to help ensure that the employer understands and complies with program requirements; require the case manager or service coordinator to approve a service backup plan; and update terminology and make minor editorial and organizational changes for clarity and consistency. -Elizabeth Jones, DADS 20. *Public Comment 21. Proposed amendment concerning Pharmacy Services – Prior Authorization Procedures. The Texas Health and Human Services Commission (HHSC) will conduct a public hearing to receive comments on the proposed amendment to §354.1832 under Title 1, Part 15, Chapter 354, Subchapter F, Division 2, Prior Authorization Procedures.  The proposed amended rule allows HHSC, under limited circumstances, to exercise discretion to waive the normal prior authorization requirement for non-preferred drugs. The Senate Committee on Health and Human Services will take up the following charges: Child Protective Services – Review the Department of Family and Protective Services. efforts to reduce child fatalities. Review the process by which the Department of Family and Protective Services collects and uses data to evaluate agency performance and improve outcomes for children in the Child Protective Services system. Make recommendations to ensure the process effectively uses data to strategically improve caseworker performance, and identify and improve upon deficiencies within the system and improve overall outcomes for children and reduce child fatalities. Women's Health – Build on previous legislative achievements in women's healthcare by examining women.s access to preventative health care, pregnancy services, and postpartum care, and exploring ways to expand access and improve quality, particularly in rural and underserved areas of the state. Monitor the implementation of women's health programs in Texas. Assess these programs' impact on outcomes such as improving access to preventative services, reducing unplanned pregnancies, and achieving cost savings. Recommend ways to better coordinate the various programs in a manner that increases the number of women served, ensures adequate provider capacity statewide, and maximizes efficiencies to the state.
