The Texas Board of Nursing will meet to consider and take action on the following: A. Consideration of temporary suspension of advanced practice registered nurse license #ap109299 with prescriptive authorization number 4285 and registered nurse license #458098 Issued to: Kathleen Ann Ferry under the authority of Tex. Occ. Code Ann. s301.455, immediate action is required of the Texas Board of Nursing because the continued practice of Kathleen Ann Ferry poses a continuing and imminent threat to the public welfare. On or about March 1, 2013 through April 20, 2015, while employed as an Adult Nurse Practitioner and owner of Gulf Freeway Wellness and Weight Clinic in Houston, Texas, and Burke Medical Clinic in Pasadena, Texas, Respondent's practice fell below the minimum standards of nursing practice in that she engaged in non-therapeutic prescribing practices. During this time period, Respondent issued thirty-seven thousand, seven-hundred and fifteen (37,715) prescriptions for controlled substances, which included dangerous drug cocktails. Dangerous drug cocktails are combinations of controlled substances, such as hydrocodone, Soma, and alprazolam, which have greater risks than therapeutic benefit when taken together. More specifically, Respondent issued prescriptions for controlled substances to patients: ACC, BHG, CHC, DAD, DCC, DLH, DLS, JAM, JF, JRS, KRB, KVW, LAB, LAD, RND, SD, SHC, SNG, and TJH, without conducting appropriate assessments to justify her prescribing practices. Respondent repeatedly prescribed hydrocodone, Soma, and/or a benzodiazepine to patients in the same doses, quantities, and strengths, indicating a failure to individually assess each patient and develop a treatment plan in response to each patient's individualized assessment. This type of prescribing falls below the standard of care in that the combination of Central Nervous System (CNS) depressants in such unsupported quantities has greater risks than therapeutic benefit. Further, Respondent failed to follow minimum standards of nursing related to pain management in that she repeatedly failed to: (a) exhaust low-risk, evidence-based treatments before resorting to high-risk, non-evidence based treatment; (b) appropriately monitor patients for aberrant and/or drug-seeking behavior; and (c) adequately collaborate or adequately document collaboration with a delegating physician. Respondent's conduct violates the following Sections of the Texas Administrative Code: 217.11(1), (1)(B), (1)(C), & (4) (effective 11/15/2007 to current); 217.12(1)(A), (1)(B), (4), & (11)(B) (effective 09/28/2004 to current); 221.12(1) (effective 2/25/2001 to current); 221.13(a) & (b) (effective 02/25/2001 to current); 222.8(b)(1) & (b)(2) (effective 11/20/2013 to current); and 228.1 (effective 02/23/2014 to current). Respondent's non-therapeutic prescribing practices constitute grounds for disciplinary action under Section 222.10(a)(1) of the Texas Administrative Code and Sections 301.452(b)(1), (10), & (13) of the Texas Occupations Code. The Board has authority to take disciplinary action under Section 301.453 of the Texas Occupations Code. On or about January 4, 2013 through April 20, 2015, while employed as an Adult Nurse Practitioner and owner of Gulf Freeway Wellness and Weight Clinic in Houston, Texas, Respondent violated state laws, rules, and regulations. Specifically, Respondent owned, operated, and issued prescriptions from a pain management clinic not registered with the Texas Medical Board. Respondent's conduct violates Section 217.11(1)(A) & (B) and 228.1(i)(5) (effective 02/23/2014 to current) of the Texas Administrative Code, as well as Sections 168.101(a) and 168.102(a) & (b) (effective 09/01/2011 to current) of the Texas Occupations Code. Respondent is subject to disciplinary action under Sections 168.202 (effective 09/01/2011 to current) and 301.452(b)(1) of the Texas Occupations Code. Section 301.453 of the Texas Occupations Code authorizes the Board to take disciplinary action. On or about March 20, 2015 through April 20, 2015, while employed as an Adult Nurse Practitioner and owner of Burke Medical Clinic in Pasadena, Texas, Respondent violated state laws, rules, and regulations. Specifically, Respondent owned, operated, and issued prescriptions from a pain management clinic not registered with the Texas Medical Board. Respondent's conduct violates Section 217.11(1)(A) & (B) and 228.1(i)(5) (effective 02/23/2014 to current) of the Texas Administrative Code, as well as Sections 168.101(a) and 168.102(a) & (b) (effective 09/01/2011 to current) of the Texas Occupations Code. Respondent is subject to disciplinary action under Sections 168.202 (effective 09/01/2011 to current) and 301.452(b)(1) of the Texas Occupations Code. Section 301.453 of the Texas Occupations Code authorizes the Board to take disciplinary action. On or about February 12, 2015, Respondent prescribed phentermine for herself in violation of state laws, rules, and regulations. The standards of care require assessment, documentation of the assessment, diagnosis, and documentation of the plan of care prior to prescribing a medication. Advanced Practice Registered Nurses are expected to meet all standards of care when issuing a prescription and are prohibited from prescribing medications for personal use. Respondent's conduct violates Sections 217.11(1)(A) & (4), and 217.12(1)(A) & (1)(B) of the Texas Administrative Code. Respondent's conduct constitutes grounds for disciplinary action under Section 222.10(a)(2) of the Texas Administrative Code and Section 301.452(b)(1) of the Texas Occupations Code. Section 301.453 of the Texas Occupations Code authorizes the Board to take disciplinary action. Under the authority of Tex. Occ. Code Ann. s301.455, the Board is required to take immediate action based upon the above conduct. Respondent's continued practice constitutes a continuing and imminent threat to the public welfare. HHS Transformation Stakeholder Comment Hearing. Health and Human Services (HHS) transformation presents an opportunity to restructure the Texas HHS system to make it more functional, efficient, effective and responsive. As this two-year transformation process unfolds, HHS agencies will be asking for input from stakeholders: the people who use health and human services, benefits and programs; people and organizations that provide services, and people and organizations that support those who use services and benefits. HHS agencies, working together, have created staff workgroups based on core functions called for in the legislation that created the opportunity for the HHS transformation. The core functions are: Medical and social services, Regulatory services, Public health, Protective services, and State-operated facilities. The workgroups will use internal program data, staff expertise and stakeholder input to develop recommendations on how a transformed HHS system should be restructured within those core functions. Phase one of this process focuses on the structure of the HHS system, while future efforts will include a more in-depth focus on program operations within the transformed structure.
