In the November 5th Texas Register the Public Utility Commission (PUC) adopted a rule change to the section regarding Substantive Rules Applicable to Electric Service Providers. Substantive Rules Applicable to Electric Service Providers

16 TAC §25.55

  • The adopted rule is the first phase of PUC’s implementation of weather emergency preparation measures for generation entities and transmission service providers (TSPs) in the Electric Reliability Council of Texas (ERCOT) power region as required by SB 3 87(R). The rule requires generators to implement the winter weather readiness recommendations identified in the 2012 Quanta Report by this winter and to fix any known, acute issues that arose from winter weather conditions during the 2020-21 winter weather season. The rule also requires TSPs to implement the key recommendations in the 2011 FERC/NERC Report and to fix any known, acute issues that arose from winter weather conditions during the 2020-21 winter weather season. Lastly, the rule requires a notarized attestation from the highest-ranking representative, official, or officer with binding authority over each of the above entities attesting to the completion of all required actions.
