However, TCEQ sent out an update today that Docket No. 2010-1048-RUL, agenda item #80, will be remanded to the Executive Director. That docket is for consideration for publication of, and hearing on, proposed amendments to sections 116.110, 116.111, 116.311, and 116.610 of 30 TAC Chapter 116, Control of Air Pollution by Permits for New Construction or Modification and corresponding revisions to the state implementation plan. The proposed rulemaking would add requirements to authorize emissions from planned maintenance, startup, and shutdown activities in New Source Review permits and standard permits.
