RRC Proposes Critical Infrastructure Rule, Adopts Weather Emergency Standards & Carbon Dioxide Rules

At its open meeting on August 30, 2022, the Railroad Commission proposed one rulemaking and adopted two others:

• The proposed amendments to §3.65 regarding Critical Designation of Natural Gas Infrastructure revise certain provisions in the rule related to Senate Bill 3 from the 87th Legislature, 2021.
• Adopted new §3.66 regarding Weather Emergency Preparedness Standards also implements provisions of Senate Bill 3.
• Adopted amendments in Chapter 5 regarding Carbon Dioxide implement provisions from House Bill 1284 (2021) concerning the RRC’s sole jurisdiction over carbon sequestration wells

All three rulemakings will be published in the Friday, September 16, 2022, issue of the Texas Register. Comments on proposed amendments to §3.65 will be accepted until 5:00 pm, Friday, October 7, 2022. The effective date of the two adoptions is Monday, September 19, 2022.
