A federal appeals court has temporarily blocked the U.S. Environmental Protection Agency’s (EPA) plan to seize control of greenhouse gas permits from Texas. Texas’ petition, asking the court to stay EPA action pending review, was filed in the U.S. Circuit Court of Appeals for the District of Columbia.

The court did order the stay pending further review noting the delay should not be interpreted as a ruling on the merits of the state’s lawsuit. EPA must file a response to the motion by Thursday, January 6.
