Exiting Post Closure Care

The Texas Commission on Environmental Quality (TCEQ) released Regulatory Guidance RG-658 Exiting Post-Closure Care for Municipal Solid Waste Landfills on November 6, 2025.

This document offers guidance on how to assess conditions at a municipal solid waste (MSW) landfill facility in Texas that has reached the end of its post-closure care (PCC) period, as well as criteria for when a facility can exit PCC.

Legislative Implementation Updates

The Waste Permits Division (WPD) has created a webpage to assist renewable energy component recycling facilities complying with House Bill (HB) 3229 reporting requirements. The first report for these facilities is due by January 15, 2026.

PD is proceeding with Rule Project #2025-031-328-WS to implement HB 3229 in 30 TAC Chapters 37 and 328. The rulemaking is scheduled for proposal at Commissioners’ Agenda on March 11, 2026.

Revised Application Form for MSW Permit, Registration Modification, or Temporary Authorization

The Application Form for Municipal Solid Waste Permit or Registration Modification or Temporary Authorization (TCEQ-20650) and instructions have been revised to improve clarity and usability. Updates include clearer attachment requirements and improved selection options to reduce errors. More information can be found on the TCEQ Search for Forms and Instructions webpage.

Request for Advisory Council Nominations

TCEQ is seeking nominations for four elected officials to serve on the Advisory Council. The vacant positions and their expiration dates are:

  • An elected official from a county with a population less than 150,000 (Expires 8/31/2027).
  • An elected official from a municipality with a population of 750,000 or more (Expires 8/31/2029).
  • An elected official from a municipality with a population between 25,000 and 100,000 (Expires 8/31/2031).
  • An elected official from a municipality with a population between 100,000 or more but less than 750,000 (Expires 8/31/2031).
