The Texas Commission on Environmental Quality (TCEQ) has started the rulemaking process to implement HB 252 (83rd R), which went into effect on September 1, 2013. The legislation requires water utilities to determine the number of days available water supply and report to the TCEQ when their available water supply is less than 180 days. The TCEQ rules will offer more detail on what utilizes are requires to report and how they will report it. It is anticipated that the rule will be proposed at the Commissioners’ Agenda on February 26, 2014.
