A decision on March 22 by the 5th U.S. Circuit Court of Appeals leaves intact Texas’ stay of the EPA’s Regional Haze rule. Last July, the 5th Circuit granted Texas’ stay motion while rejecting the EPA’s motion to dismiss or transfer, explaining that Texas had shown enough evidence to support a case on the merits. Texas Attorney General Ken Paxton commended the ruling. A copy of the decision maintaining the stay is hosted by the AG here.
