On August 30, Federal Judge Orlando Garcia of the Western District Court of Texas granted a preliminary injunction against implementing and enforcing certain provisions of sanctuary cities bill SB 4. The injunction prevents enforcement of provisions in SB 4 which require local and campus law enforcement to “comply with, honor, and fulfill” any detainer request from ICE, as well as bill prohibitions on department policies limiting enforcement of immigration law or the ability of officers to assist or cooperate with federal immigration officers. The injunction is designed to “preserve the relative positions” of involved parties until a trial on the merits of the case can be held. SB 4 was passed during the 85th Regular Session and was set to go into effect on September 1 of this year.
