The Texas Department of Insurance invites comments on the informal working draft of rules implementing HB 1624, enacted by the 84th Texas Legislature (2015), relating to prescription drug formulary disclosure requirements. The purpose of this informal working draft is to obtain public and stakeholder input regarding requirements related to formulary disclosures and consumers' ability to compare prescription drug benefits.

The informal draft implements the statute, includes metrics to facilitate consumers’ ability to compare formulary value and scope, and makes minor changes to other sections of TAC Chapter 21, Subchapter V. Amendments to the subchapter include updating references to the Insurance Code, adjusting ID card requirements to conform to the statute, and clarifying the applicability of 28 TAC §21.2820 to certain pharmacy ID cards.
