Health and Human Services Commission (HHSC) will conduct a public hearing to receive comments on various proposed amendments to the following chapters of Title 1 of the Texas Administrative Code: Chapter 358, relating to Medicaid Eligibility for the Elderly and People with Disabilities; Chapter 359, relating to the Medicare Savings Program; Chapter 360, relating to the Medicaid Buy-In Program; Chapter 361, relating to the Medicaid Buy-In for Children Program; Chapter 366, relating to Medicaid for Women, Children, Youth, and Needy Families; Chapter 370, relating to the State Children's Health Insurance Program; and Chapter 372, relating to Temporary Assistance for Needy Families and Supplemental Nutrition Assistance Programs. The proposed amendments revise Chapters 358, 359, 360, 361, 366, and 372 to exclude Achieving a Better Life Experience (ABLE) accounts or school-based savings accounts from being counted as income or resources when determining eligibility for the programs regulated by those chapters, in accordance with Senate Bill 1664, 84th Leg., R.S., and House Bill 3987, 84th Leg., R.S. The proposed amendments also align Chapter 358 with United States Supreme Court's recognition of same-sex marriage in Obergefell v. Hodges, 576 U.S. 135 (2015). In addition, the proposed amendments align Chapters 366, 370, and 372 with federal law and policy, the Medicaid state plan, or current HHSC policy and processes. Proposed Payment Rates for 24-Hour Residential Child Care Foster Care Redesign. Hearing. Health and Human Services Commission (HHSC) will conduct a public hearing on Aug. 26, 2016, at 3 p.m. to receive public comments on proposed blended rates for Single Source Continuum Contractors (SSCCs) under Foster Care Redesign (FCRD) in the 24 Hour Residential Child Care program. The 24 RCC program is operated by the Texas Department of Family and Protective Services. The hearing will be held in compliance with Texas Human Resources Code §32.0282 and Title 1 of the Texas Administrative Code (1 TAC), §355.7103(a)(2), which require that public hearings be held on proposed reimbursement rates before such rates are approved by HHSC. Proposal. HHSC proposes to increase the Region 3 blended rate for the SSCCs. The proposed rate accounts for actual and projected increases in the case-mix of the children served by the SSCC. The new blended rate for Region 3 is proposed to be adopted effective Sept. 1, 2016. HHSC also proposes a blended rate and an exceptional care rate for the SSCCs for the proposed expansion of FCRD into Region 2. The proposed rates will be included in the Request for Proposals for the expansion of FCRD for use by entities interested in submitting a proposal. The rates for Region 2 are proposed to be adopted effective Sept. 30, 2016. Methodology and Justification. The proposed rates were determined in accordance with the rate setting methodologies codified as 1 TAC §355.7103(r), Rate-Setting Methodology for 24-Hour Residential Child-Care Reimbursements.
