The Staff of the Public Utility Commission (PUC) held a workshop on Monday, June 9, 2014 to discuss changes to Subchapter H of the Commission's Procedural Rules relating to limitations on discovery in rate proceedings. This workshop concluded the timeline set forth in the rulemaking proceedings. The draft rule contained changes pertaining to limiting discovery in rate proceedings by requiring the presiding officer to adopt a discovery control plan, taking into consideration: 1) the discovery period; 2) the alignment of the parties; and 3) reasonable limits that would prohibit duplicative, unnecessary, or harassing discovery.
