After many hours of debate and impassioned closing speeches, the House has passed HB 1, as amended, on 2nd and 3rd reading with 98 ayes and 49 nays.

41 additional floor amendments were adopted tonight in Articles IV thru X and all Article XI amendments were adopted.

A total of 177 floor amendments were adopted.

Earlier tonight an amendment made by Rep. Phil King requires all agency fees in HB 1 to have enabling legislation. When the budget debate began on Friday it was noted there were $100 million in fees in HB 1 that would be enacted without any additional legislation. King’s amendment, which was adopted, now requires all new or increased agency fees in HB 1 to have enabling legislation passed before being imposed. 

The text of the amendment follows:

Fee Revenue Increases Contingent on Legislation.

Notwithstanding any other provision of this Act, it is the intent of the legislature that any provision of this Act regarding the revenues resulting from an increase in the amount or rate of a fee imposed or collected by a state agency, from an expansion of the population of those on which a fee imposed by a state agency or from which a fee is collected by a state agency, or from the imposition of a new fee is contingent on a bill that authorizes the appropriation of the resulting increase in the agency’s fee revenue being enacted by the 82nd Legislature, Regular Session, 2011, and becoming law.
