After a TCEQ evaluation of the oil and gas permit by rule (PBR), it was discovered that the permit by rule and the associated oil and gas standard permit lack a tiered approach that exists for all other industries. The oil and gas PBR is to be revised to provide this tiered approach. The standard permit would be repealed and issued as a non-rule with the tiered approach. After further testimony and discussion on this rule, the commission delayed adoption until the January 26th meeting.
