In 2007, the 80th Texas Legislature enacted Section 13.146 of the Texas Water Code. As a result of the legislation, retail public water utilities that provide water service to 3,300 or more connections must submit a water conservation plan to the Texas Water Development Board. The 80th Texas Legislature also enacted Section 16.402 of the Texas Water Code, which requires these utilities to report annually on the implementation of the plan. The conservation plans were due May 1, 2009, and the first annual implementation report is due May 1, 2010. The plan must be reviewed and submitted once every five years thereafter.
