The Senate Committee on Finance met on February 15th to discuss the following Article VIII agencies. This report focuses on LBB and agency presentations for the following topics:

This report is intended to give you an overview and highlight the various topics taken up. It is not a verbatim transcript of the discussions but is based upon what was audible or understandable to the observer and the desire to get details out as quickly as possible with few errors or omissions.
Public Utility Commission

- The PUC suggests increasing the appropriation from this GR-D account $5m per FY or shifting the financing of water regulation from Fund 153 to GR

- Kolkhorst – Have been hesitant to do that; need to make sure PUC has a sufficient amount of employees; notes RRC has grown as the legislature has required more including weatherization
- Chair Huffman – Some appropriate items were left out so members could work through them
- Nichols – Have not heard about making a new regulatory body to regulate water; notes giving regulation back to TCEQ is not the way to do it
Peter Lake, Chairman PUC
- Have increased responsibility, including with water, and have less employees; need resources to attract/keep talent
Thomas Gleeson, Executive Director PUC
- Will focus on three exceptional items
- $4.5m each FY for 51 additional FTEs; have lost many professionals and attorney turnover has been 50%
- Asking for GR funding for a 5 percent salary increase for all agency staff and a 10 percent salary increase for Attorneys and other licensed professionals to reduce staff turnover rates
- Asking for GR and GR-D funding with authority for an additional 3 FTEs to establish a new Office of Public Participation; have already stood the division up and want to build this out
- Asking for GR funding for a data analysis team within the Market Analysis division
- Asking for GR funding for an Energy Efficiency Plan and Outreach team
- Requests are prudent to meet the demands of the state
- Schwertner – Agree you need more FTEs; how much are you asking for water/wastewater?
- 50% of additional GR resources would go to water
- Schwertner – Have been sections in SB 3 that have not been implemented including emergency pricing and cost causation; requesting enough FTEs to fully implement?

- Lake – Have not been advised of that
- Schwertner – Nodal Protocol Revision Request 1156 comments about verbal directives? Seems to be in contradiction to the advice given by the legislature

- Hancock – Have you seen new security council be effective and are there budgetary needs?
- Lake – Yes; outside of agency appropriations need funding for security of the grid
- Exceptional item 3 is about improving cybersecurity posture
- Perry – Agree utility and water are totally different processes?
- Lake – Agree
- Perry – If we were to move that to its own would it be beneficial to your operations?
- Lake – Water deserves its own center of focus; either needs its own or more funding at PUC
- Zaffirini – Benefit of becoming self-funded and self-leveling?
- If there was a need for agencies to do budget reductions, would be exempt
- Zaffirini – Requested sufficient funding to cover all responsibilities?
- Some are covered in request and provided Sunset with estimates of what it would take to fund all initiatives
- Zaffirini – Can meet creation of a state reliability standard deadline?

- Fee is set by TCEQ set around 0.5% to 1.5% based on their gross revenues
- Would change to our gross receipts assessment is 1/6 of whatever they are paying today
- Chair Huffman – How much do you pay a starting attorney? Losing out to the private sector?
- $70k and has not affected turnover rates; yes
- Chair Huffman – Need attorneys that specialize in water issues?
- Everyone works on every topic
- Chair Huffman – We need to have dependable staff and be willing to pay them as we are competing with the private sector; $70k is not competitive
- Whitmire – Should put a dollar amount to lost comp time
- Schwertner – Sunset staff, asks about PUC response to the NPRR1156?
- Emily Johnson, Sunset Staff – Was concern among industry that directives need to be in writing; ERCOT’s concern that may be getting ahead of potential changes in law
- Schwertner – ERCOT will continue with verbal directives; are jumping ahead of us
- Lake – Will look into this
- West – No market data analytics team there already? How would you get this info before?
- No; Glotfelty felt we needed this on staff to leverage with universities like A&M who are already doing this work
- West – Historically there have been no checks and balances? This would allow for that?
- Correct; have had no way to do independent modeling or verification

- UB authority has helped the agency have flexibility to participate in cases

- TDI is funded primarily by maintained taxes and fees
- Requesting additional $450k for replacement of vehicles in the agency’s fleet
- Perry – All insurance is under your umbrella?
- Correct
- Perry – Breakdown of resource allocation? Biggest issue?
- Largest division is financial regulation; ensures companies remain solvent to pay claims
- Perry – How much of the states health insurance plans are self-insured that do not fall under your umbrella? How many resources go towards this?
- TDI regulates 17% of the health insurance market; takes a majority of our resources
- Perry – Think this is a conversation for another day as something that is 17% of your purview but takes up a majority of your resources
- Perry – Asks about how ensure solvency for companies?
- License the insurance company and review their rates; last year saved consumers $16m in rate reviews
- Zaffirini – Employ the same criteria for men and women?
- Correct; based on pre-injury wages
- Kolkhorst – Premiums will stabilize soon?
- Not yet; inflation is the driving cost, not sure when inflation will stabilize
- Kolkhorst – Asks about windstorm defaults
- Florida and Louisiana had insolvency; were stop gaps aimed to reduce effect on Texas
- Insolvency happens a lot and all we can do is get advanced warning to alert consumers
- Hancock – All insurance has gotten more expensive – TWIA itself has worked to limit increases?
- Consumers along the cost are buying three different policies
- Have not seen as great increases in TWIA as in other markets
- Hinojosa – Mostly due to Governor and coastal representatives pushing back on rate increases
- Kolkhorst – Asks about involuntary increases in rates
- Is an inflationary adjustment for insurers; consumers had the option to not take that automatic increase for TWIA
- Paxton – Division of workers compensation; was an 81% reduction in most addictive opioid prescriptions
- Implemented a pharmacy formulary to bring those numbers down; other states have used our formulary as a model
Department of Licensing and Regulation

- Sunset recommended State Board of Veterinary Examiners be added to TDLR for four years; full fiscal impact cannot be estimated at this time

- Nichols – Unit is fairly new in Hughes’ district; is unique in the nation; impacts all of our districts

Mike Arismendez, Executive Director TDLR
- Since 2015 TDLR has had a 37% increase in the agency; Sunset report stated we had to adjust operations in response to pressure points
- Thanks for the 10% cost of living increase for staff
- Have assumed technical debt of the systems transferred to us
- Priority exceptional item is $32.9m to acquire a modern licensing system
- Exceptional item $3.2m to fund current FTE staff and increase salaries for IT staff
- Exceptional item increase of $5m to combat financial fraud; have recovered or diverted $51m in financial fraud
- Exceptional item request for $2.1m for 14 FTEs for the anti-trafficking program
- Nichols – Agency has a great reputation; concerned we do not overload the agency
- Nichols – How many licenses do you; will possibly be putting EV charging stations on you; Schwertner has filed a bill concerning this
- Almost 900k licenses
- Have been in conversation with Schwerner’s office
- Nichols – How much for those EV licenses? Heard would be $50
- Do not have a fiscal note on that bill yet; will get back to you
- Nichols – Concerned about the high license cost to put in an electric charging meter
- Zaffirini – Timeline for new licensing system; would create efficiencies?
- Would be cloud-based and reduce timeframe to generate licenses
- Zaffirini – How successful since passing legislation on card skimming?
