Eligibility and Disciplinary Committee Meeting 1. Call to order – 9:00 AM 2. Review of the agenda 3. The Texas Board of Nursing will meet to consider and take action on the following: A. Consideration of temporary suspension of registered nurse license #825708 Issued to: Kami Danielle Chapman Under the authority of Tex. Occ. Code ann. s301.4551, immediate action is required of the Texas Board of Nursing because the continued practice of Kami Danielle Chapman poses a continuing and imminent threat to the public welfare. On or about April 28, 2014, Respondent became non-compliant with the Agreed Order issued to her by the Texas Board of Nursing on December 30, 2013, which required Respondent to successfully complete the Texas Peer Assistance Program for Nurses (TPAPN). Non-compliance is the result of Respondent submitting one (1) specimen for drug screens that produced positive results for Alcohol (ETG 2580 ng/mL, ETS 3450 ng/mL). Stipulation Number Three (3) of the agreed order dated December 30, 2013, states in pertinent part: Respondent shall comply with all requirements of the TPAPN participation agreement during its term and SHALL keep all applicable license(s) to practice nursing in the State of Texas current. On or about May 27, 2014, Respondent's case was closed with TPAPN for noncompliance and was referred to the Board for further disposition. Under the authority of Tex. Occ. Code Ann. – 301.4551, the Board is required to take immediate action based upon the above conduct. Respondent's continued practice constitutes a continuing and imminent threat to the public welfare. B. Consideration of temporary suspension of vocational nurse license #172254 Issued to: Jacquelynn Kay Hanke Under the authority of Tex. Occ. Code ann. s301.4551, immediate action is required of the Texas Board of Nursing because the continued practice of Jacquelynn Kay Hanke poses a continuing and imminent threat to the public welfare. On or about April 22, 2014, Respondent became noncompliant with the Agreed Order issued to her by the Texas Board of Nursing on May 7, 2012. On or about April 22, 2014, Respondent engaged in the intemperate use of alcohol and opiates in that she produced a specimen for a random drug screen that resulted positive for Ethyl Glucuronide and Ethyl Sulfate, both metabolites of alcohol, and Hydrocodone and Hydromorphone. Additionally, on or about May 22, 2014, Respondent engaged in the intemperate use of marijuana in that she produced a specimen for a random drug screen that resulted positive for the marijuana metabolite (THC). Respondent's noncompliance is the result of her failure to comply with Stipulation Number Eight (8) of the Order, dated May 7, 2012, which reads: "Respondent shall abstain from the consumption of alcohol, Nubain, Stadol, Dalgan, Ultram, or other synthetic opiates, and/or the use of controlled substances, except as prescribed by a licensed practitioner for a legitimate purpose. If prescribed, Respondent shall cause the licensed practitioner for a legitimate purpose. If prescribed, Respondent shall cause the licensed practitioner to submit a written report identifying the medication, dosage and the date the medication was prescribed…" Under the authority of Tex. Occ. Code Ann. – 301.4551, the Board is required to take immediate action based upon the above conduct. Respondent's continued practice constitutes a continuing and imminent threat to the public welfare. C. Consideration of temporary suspension of registered nurse license #813415 Issued to: Rebecca Lynn Hiatt Under the authority of Tex. Occ. Code ann. s301.4551, immediate action is required of the Texas Board of Nursing because the continued practice of Rebecca Lynn Hiatt poses a continuing and imminent threat to the public welfare. On or about June 2, 2014, Respondent became noncompliant with the Agreed Order issued to her on November 22, 2013, by the Texas Board of Nursing. Non-compliance is the result of her failure to return the items necessary to initiate participation within the required time frame. Stipulation Number One (1) of the Agreed Order, dated November 22, 2013, states, in pertinent part: "Respondent shall, within forty-five (45) days following the date of entry of this final Order, apply to TPAPN and Shall, within ninety (90) days following the date of entry of this final Order, sign and execute the TPAPN participation agreement and complete the enrollment process, which SHALL include payment of a non-refundable participation fee in the amount of five hundred dollars ($500.00) payable to TPAPN." On or about June 2, 2014, Respondent was dismissed from TPAPN and referred back to the Board. Under the authority of Tex. Occ. Code Ann. – 301.4551, the Board is required to take immediate action based upon the above conduct. Respondent's continued practice constitutes a continuing and imminent threat to the public welfare. D. Consideration of temporary suspension of registered nurse license #825596 Issued to: Jessica Isabel Hinojosa Under the authority of Tex. Occ. Code ann. s301.4551, immediate action is required of the Texas Board of Nursing because the continued practice of Jessica Isabel Hinojosa poses a continuing and imminent threat to the public welfare. On or about May 17, 2014, while employed as a Registered Nurse with Valley Baptist Health Systems, Harlingen, Texas, Respondent was noncompliant with the Agreed Eligibility Order issued to her by the Texas Board of Nursing on May 16, 2012. Noncompliance is the result of Respondent's failure to comply with all requirements of the Texas Peer Assistance Program for Nurses (TPAPN) contract in that she admitted to her employer that she consumed alcohol. Prior to Respondent's admission, she was observed displaying impaired behavior, and she smelled of alcohol. Stipulation Number Three (3) of the Agreed Eligibility Order dated May 16, 2012, reads: "Petitioner shall comply with all requirements of the TPAPN contract during its term." On or about June 3, 2014, Respondent was dismissed from TPAPN and referred to the Texas Board of Nursing. Under the authority of Tex. Occ. Code Ann. – 301.4551, the Board is required to take immediate action based upon the above conduct. Respondent's continued practice constitutes a continuing and imminent threat to the public welfare. E. Consideration of temporary suspension of registered nurse license #821044 Issued to: Kristin Lynn Masters Under the authority of Tex. Occ. Code ann. s301.4551, immediate action is required of the Texas Board of Nursing because the continued practice of Kristin Lynn Masters poses a continuing and imminent threat to the public welfare. On or about June 16, 2014, you became noncompliant with the Order issued to you by the Texas Board of Nursing on January 24, 2014. Noncompliance is the result of your failure to abstain from the consumption of alcohol in that you submitted a specimen for a drug screen which resulted positive for Ethyl Glucuronide (EtG) and Ethyl Sulfate (EtS), metabolites of alcohol. Stipulation Number Ten (10) of the Order dated January 24, 2014, reads, in pertinent part: "Respondent shall abstain from the consumption of alcohol…" Under the authority of Tex. Occ. Code Ann. – 301.4551, the Board is required to take immediate action based upon the above conduct. Respondent's continued practice constitutes a continuing and imminent threat to the public welfare. F. Consideration of temporary suspension of registered nurse license #642237 Issued to: Cynthia Morrow Under the authority of Tex. Occ. Code ann. s301.4551, immediate action is required of the Texas Board of Nursing because the continued practice of Cynthia Morrow poses a continuing and imminent threat to the public welfare. On or about May 20, 2014, Respondent became noncompliant with the Agreed Order issued to her by the Texas Board of Nursing on July 16, 2013. Noncompliance is the result of Respondent's failure to comply with all requirements of the Texas Peer Assistance Program for Nurses (TPAPN) participation agreement in that she produced a specimen for a drug screen, which resul

Beginning September 1, 2014, certain individuals with intellectual and developmental disabilities (IDD) who are covered by Medicaid will receive their basic medical services, or acute care, through a STAR+PLUS managed care health plan.  The Texas Health and Human Services Commission is holding provider trainings across the state to educate providers who serve individuals with IDD on STAR+PLUS managed care and what changes to expect. Proposed Medicaid Payment Rates for the Medical Transportation Program. Hearing.  Health and Human Services Commission (HHSC) will conduct a public hearing to receive public comment on proposed Medicaid payment rates for the Medical Transportation Program.  The hearing will be held in compliance with Human Resources Code §32.0282 and the Texas Administrative Code, Title 1 (1 TAC), §355.201, which require public notice of and hearings on proposed Medicaid reimbursements.   HHSC also will broadcast the public hearing; the broadcast can be accessed at http://www.hhsc.state.tx.us/news/meetings.asp. The proposed payment rates were calculated in accordance with 1 TAC: §355.102, which addresses the general principles of allowable and unallowable costs; §355.201, which addresses the establishment and adjustment of reimbursement rates by HHSC; §355.8085, as effective on June 29, 2014, which addresses the reimbursement methodology for physicians and other practitioners, in addition to payments for laboratory and x-ray services, radiation therapy, physical therapists' services, physician services, podiatry services, chiropractic services, optometric services, ambulance services, dentists' services, psychologists' services, licensed psychological associates' services, maternity clinic services, and tuberculosis clinic services; and §355.8561, which addresses the reimbursement methodology for medical transportation. On September 1, 2014, the STAR+PLUS Medicaid managed care program will expand statewide to the rural service areas of Texas (Central, Northeast, and West).  People who are age 65 or older or who have disabilities and are covered by Medicaid will begin receiving services through a STAR+PLUS managed care health plan.  The Texas Health and Human Services Commission (HHSC) is holding provider trainings across the three rural service areas to educate providers on STAR+PLUS managed care and what changes to expect.
