The Texas Commission on Environmental Quality (TCEQ) has proposed changes to Chapter 116, Control of Air Pollution by Permits for New Construction or Modification. The proposal was published in the February 28 Texas Register. No changes were made to the proposed rule as published. There were no substantive changes from proposal. Two minor changes to terminology were made in response to comments. 
 
If approved by commissioners, the anticipated effective date will be July 31. The proposed rulemaking would satisfy the conditional approval by the United States Environmental Protection Agency of the commission’s air quality Flexible Permit Program (FPP) to ensure that the FPP is fully approved as part of the Texas SIP.
