Rep. Richard Peña Raymond, Chair of House Committee on Human Services, sent a request for an opinion to the Attorney General on June 3. Rep. Raymond raised issues regarding an MCO participating in a Medicaid program which allegedly has been “retrospectively ‘recouping’ 30% of previously paid reimbursement to providers for behavioral health services.
 
Particularly he raised three questions relating to the validity of administrative rule 1 T.A.C. § 355.8091, which provides for Medicaid reimbursement to specified licensed counselors and also concluded his request inviting comment from the Texas Health and Human Services Commission, the Texas Department of Insurance, the Texas Medical Board, the Texas State Board of Examiners of Psychologists, as well as the other boards that regulate behavioral health specialists.
 
The Attorney General’s office has received the request for opinion and will issue a response in the coming months.
