Proposed Rules for Medicaid Eligibility Changes for Former Foster Care Youth. The Texas Health and Human Services Commission (HHSC) will conduct a public hearing to receive comments on the proposed new rules and amendments to existing rules under Title 1, Part 15, Chapter 366, concerning the implementation of Medicaid eligibility changes for former foster care youth. The proposed rules accomplish two objectives. First, the proposed rules align the eligibility requirements of Medicaid for Transitioning Foster Care Youth (MTFCY) with the eligibility requirements of the new Former Foster Care Children's (FFCC) program.  Federal law requires a state to cover former foster care adolescents who were in foster care under the responsibility of the State on the date of attaining 18 years of age or such higher age as specified in state law. 42 U.S.C. §1396a(a)(10)(A)(i)(IX). The proposed rules align MTFCY to FFCC by providing coverage only to former foster care youth who had been in Texas conservatorship. Second, the proposed rules provide coverage to former foster care youth who were approved by this State for placement inside or outside Texas in accordance with the Interstate Compact on the Placement of Children, codified at Texas Family Code §162.102, and to former foster youth from any state who were receiving Medicaid services in Texas on or before December 31, 2013, subject to other conditions of eligibility. Consider recommendations from the Pediatric committee regarding the Washington State Guidelines for Transport, and related items addressed in that report. 5. In addition, the amended rules update references to agencies, delete obsolete citations and definitions, and update language to reflect current policy for the MTP. Proposed amended rules concerning Medicaid Managed Care. The Health and Human Services Commission (HHSC) will conduct a public hearing to receive comments on the proposed amendments to the following sections: §§353.2 and 353.4, under Title 1, Part 15, Chapter 353, Subchapter A, concerning General Provisions; §§353.403, 353.407, 353.409, 353.417, and 353.421 under Title 1, Part 15, Chapter 353, Subchapter E, concerning Standards for Medicaid Managed Care; §§353.601 and 353.603 under Title 1, Part 15, Chapter 353, Subchapter G, concerning STAR+PLUS; §§353.701 and 353.702 under Title 1, Part 15, Chapter 353, Subchapter H, concerning Star Health; §353.802 under  Title 1, Part 15, Chapter 353, Subchapter I, concerning STAR; and §353.909 under Title 1, Part 15, Chapter 353, Subchapter J, concerning Outpatient Pharmacy Services. The proposed amendments were published in the April 25, 2014, issue of the Texas Register. See 39 TexReg 3304. To implement Senate Bill 7, HHSC proposes to amend the rules to specify that STAR+PLUS serves members in all service areas in the state.  Consequently, beginning September 1, 2014, individuals who are enrolled in the Community-Based Alternatives, primary home care, or day activity health services programs through Department of Aging and Disability Services, and who qualify for STAR+PLUS will be required to enroll in a STAR+PLUS managed care organization for all of their Medicaid benefits. HHSC further proposes to amend the rules to specify that certain populations will no longer be excluded from being enrolled in STAR+PLUS statewide. Specifically, two populations will be required to enroll in STAR+PLUS: beginning September 1, 2014, adults residing in a community-based Intermediate Care Facilities for Individuals with an Intellectual Disability (ICF-IID) or receiving services under an ICF-IID 1915(c) waiver will receive acute care Medicaid benefits through STAR+PLUS; and beginning March 1, 2015, adult residents of a nursing facility will receive all Medicaid benefits through STAR+PLUS. Additionally, one population—children residing in a community-based ICF-IID or receiving services under an ICF-IID 1915(c) waiver–may choose to receive acute care Medicaid benefits through STAR+PLUS, but will not be required to do so.  HHSC also proposes to amend the rules to specifically exclude certain Medicaid clients from participating in STAR+PLUS, such as children residing in nursing facilities, residents of state supported living centers, and persons enrolled in Programs for All-Inclusive Care for the Elderly.  In connection with the implementation of Senate Bill 7, HHSC proposes rule amendments to: update definitions impacted by the legislative changes; clarify the minimum amount of time a beneficiary has to choose a managed care organization (MCO) or a primary care provider; clarify situations when a member may move from one MCO to another or disenroll from managed care altogether; and clarify that an MCO may not disenroll or transfer certain members who may be disruptive due to their disability as a result of the disruption.
