The Texas Education Agency (TEA) has released correspondence addressing school safety updates related to enhanced monitoring and commissioner rulemaking.
The following safety requirements are in the proposal process currently and expect to be adopted for the 2026-2027 school year:
19 Texas Administrative Code (TAC), §103.1209, Mandatory School Drills
- 19 TAC §103.1209is in the amendment process to incorporate requirements outlined in Senate Bill 57, 89th Regular Legislative Session, related to students and staff with disabilities having equal access to safety during required school drills and emergency events.
19 TAC §61.1031, School Safety Requirements
- 19 TAC §61.1031 is being repealed for adoption as 19 TAC §103.1215. Once adopted, this rulemaking will clarify existing school safety requirements and incorporate updates from the 89th Regular Legislative Session.
19 TAC §103.1217, Safety During Extra Curricular Activities
- TEC, §37.1083, requires the agency to ensure that school systems include provisions for ensuring the safety of students, staff, and spectators attending extracurricular activities in their multihazard emergency operations plans under TEC, §37.108(f)(8). 19 TAC §103.1217 will be the rulemaking associated with Safety During Extracurricular Activities.
- 19 TAC §103.1217 posts to the Texas Register on April 17, 2026, and will be available for review on the Texas Secretary of State website.
19 TAC §103.1219, Assignment of a Conservator
- TEC, §37.1085, authorizes the Commissioner of Education to assign a conservator if a school system fails to submit to any required school safety-related monitoring, assessment, or audit, fails to comply with school safety requirements, or fails to address issues raised by the agency’s monitoring, assessment, or audit of the school system
- 19 TAC §103.1219will be the rulemaking associated with Assignment of a Conservator for Noncompliance with School Safety and Security Requirements.
To enhance school safety, the TEA Office of School Safety and Security implemented a multi-tiered Enhanced Monitoring Plan for campuses with persistent Intruder Detection Audit (IDA) findings. At each tier, enhanced monitoring increases school system accountability while also providing the school system with technical assistance needed to create a safe environment.
