Attorney General Ken Paxton has joined a multistate amicus brief in the United States Third Circuit Court of Appeals in support of the defendant energy companies in Delaware v. BP America, Inc. The brief argues that Delaware’s claim attempts to regulate interstate pollution, that the appropriate venue is in federal court, and the case should be tried under federal common law.
