In the July 4 Texas Register the State Board of Dental Examiners proposed new rule 22 TAC §108.15, concerning notification of discontinuance of practice. Among other things the new rule would require notification from the dentist to the patients when a dentist retires, relocates his or her dental practice, terminates employment, or otherwise leaves a dental practice, with some exceptions. The dentist would need to ensure that patients seen by the dentist within the last two (2) years receive notification of the date of discontinuance of practice and are given the opportunity to obtain copies of their records or arrange for the transfer of their dental records to another dentist as provided in the title.

Comments on the proposed rule may be submitted within 30 days of publication in the Texas Register. The earliest possible date of adoption of this rule is August 3, 2014.
