Tuberculosis (TB) Institution Exclusion The Texas Health and Human Services Commission (HHSC) proposes to amend Title 1, Part 15, Chapter 354, Subchapter A, Division 10, 354.1121, concerning Definitions; Division 11, 354.1149, concerning Exclusions and Limitations; and Division 28, 354.1371, concerning Benefits and Limitations. The proposed amendments remove the prohibition against a tuberculosis (TB) institution receiving Texas Medicaid payment for inpatient services. Sections 354.1121 and 354.1149 are amended to update the definition of "hospital" and remove the exclusion of inpatient services in TB institutions from the description of covered Medicaid services. The title for 354.1371 is proposed for amendment to clarify that the rule applies only to TB clinics. – Alex Melis, HHSC 7. Private Duty Nursing Services HHSC proposes to repeal Title 1, Part 15, Chapter 363, Subchapter C, concerning Private Duty Nursing Services, in its entirety and propose new rules for this subchapter. The proposed changes to Chapter 363, Subchapter C address requirements in the Second Partial Settlement Agreement in Alberto N. v. Janek, Section 8.4, under which HHSC must conform its Private Duty Nursing (PDN) rules to the terms of the settlement agreement. HHSC, the Office of the Texas Attorney General, and the Alberto N. Plaintiffs'f counsel negotiated the specific wording of the rules. The proposed rules are the product of that negotiation process and represent HHSC'fs effort to conform its PDN rules to the terms and conditions of the settlement agreement. – Brian Dees, HHSC 8. Authorized Physician Services, concerning Anesthesiologist Assistants The Texas Health and Human Services Commission (HHSC) proposes to amend Title 1, Chapter 354, Subchapter A, Division 5, 354.1062, concerning Authorized Physician Services. The proposed amendments add services provided by an anesthesiologist assistant to the services for which a physician may bill Texas Medicaid. The amendments align the rule with other program rules (''354.1064 and 354.1065) relating to anesthesiologist assistants' services. The proposed rule also corrects a reference to the title of a rule regarding certified registered nurse anesthetists. – Kami Geoffray, HHSC 9. Nursing Facility Requirements The Health and Human Services Commission (HHSC), on behalf of the Department of Aging and Disability Services (DADS), proposes to amend Title 40, Part 1, Chapter 19, concerning Nursing Facility Requirements for Licensure and Medicaid Certification. The proposed amendments ensure consistency with current federal Minimum Data Set 3.0 requirements. The proposal also requires notice of the loss of permanent medical necessity status for a resident; updates outdated terminology; adds an assisted living facility as a type of residential facility to which a resident may be discharged; and deletes certain nursing documentation requirements related to the previous Texas Index for Level of Effort reimbursement methodology. – Randy Rowley, DADS 10. Medicaid Bed Allocation Requirements for Nursing Facilities The Health and Human Services Commission (HHSC), on behalf of the Department of Aging and Disability Services (DADS), proposes an amendment to Title 40, Part 1, Chapter 40, Subchapter X, 19.2322, concerning Medicaid Bed Allocation Requirements. The proposed amendment responds to Human Resources Code 32.0213(d), as added by House Bill 3196, 83rd Legislature, Regular Session, 2013, which requires an applicant for Medicaid beds in a nursing facility under a Medicaid bed waiver application to provide a performance bond of $500,000 or other financial security as determined by DADS. The purpose of the performance bond is to ensure that the applicant provides the Medicaid beds granted under the waiver within the time frame required by DADS. The amendment also clarifies when Medicaid beds allocated through a specific waiver (e.g., Alzheimer's waiver or state veterans home waiver) can be decertified and de-allocated and clarifies that Medicaid beds allocated through the small house waiver are not included in determining the allowable bed allocation increase in a nursing facility. – Bobby Schmidt, DADS 11. Local Intellectual and Developmental Disability Authority Responsibilities for Preadmission Screening and Resident Review The Health and Human Services Commission (HHSC), on behalf of the Department of Aging and Disability Services (DADS), proposes new sections in Title 40, Chapter 17, concerning Preadmission Screening and Resident Review (PASRR). The proposed sections describe the responsibilities of a Local Intellectual and Developmental Disabilities Authority (LIDDA) and a Local Mental Health Authority related to Preadmission Screening and Resident Review (PASRR). PASRR is required by the Code of Federal Regulations, Title 42, Part 483, Subpart C to ensure that individuals with a mental illness (MI), an intellectual disability (ID), or a developmental disability (DD) who choose admission into a Medicaid-certified nursing facility: (a) are appropriate for nursing facility care; and (b) receive all necessary specialized services to meet their overall physical, mental and psychosocial needs. The proposal describes the responsibilities of a LIDDA for providing service planning and transition planning for Medicaid-eligible residents who are 21 years of age or older and who have an ID or DD. – Geri Willems, DADS 12. Nursing Facility Responsibilities for Preadmission Screening and Resident Review The Health and Human Services Commission (HHSC), on behalf of the Department of Aging and Disability Services (DADS), proposes a new Title 40, Chapter 19, Subchapter BB, concerning Nursing Facility Responsibilities Related to Preadmission Screening and Resident Review (PASRR). The proposed subchapter describes the responsibilities of a nursing facility (NF) related to Preadmission Screening and Resident Review (PASRR), which is required by the Code of Federal Regulations, Title 42, Part 483, Subpart C. The proposal requires a PASRR Level I screening for all individuals and PASRR Level II evaluation for all individuals identified as having an intellectual disabil
ity, developmental disability, or mental illness. The proposal also requires each NF plan of care to contain the additional specialized services for which the NF is responsible and requires each NF comprehensive plan of care to describe coordination expectations of the NF related to additional services recommended by the service planning team and agreed upon by the NF. The proposal also requires the NF to allow the local intellectual and development disabilities authority (LIDDA) service coordinator access to a resident's records during visits and to allow LIDDA contractors to speak with residents about community options. – Sharon Wallace, DADS 13. In a proposed Medicaid Pharmacy Outpatient Rule published on February 2, 2012, by the Centers for Medicare & Medicaid Services (CMS) (CMS']2345']P) to amend 42 CFR part 447, subpart I, CMS proposes to replace estimated acquisition cost with actual acquisition cost as the basis for state Medicaid pharmacy ingredient cost reimbursement. Proposed Payment Rates for Community First Choice. This meeting will be webcast. Hearing.  The Health and Human Services Commission (HHSC) will conduct a public hearing to receive public comment on proposed payment rates for the Community First Choice (CFC) program.  The Department of Aging and Disability Services and HHSC operate various aspects of the CFC program.  The payment rates are proposed to be effective March 1, 2015.  The public hearing will be held in compliance with Human Resources Code §32.0282 and Title 1 of the Texas Administrative Code (TAC) §355.105(g), which require public notice and hearings on proposed reimbursement rates.
