TCEQ conducted a stakeholder meeting on Monday, September 11, 2017 to obtain input from the public on the rulemaking required by House Bills 1648 and 3735 and Senate Bills 864 and 1430. The rules will include expedited amendments, notice and conservation.
 
At the meeting, Staff announced several specific questions for which the ED is seeking input. The questions and additional information are available on the TCEQ websiteTCEQ is accepting comments through September 26, 2017.
 
Tentative Timeline:

  • Filing rule proposal: January 19, 2018
  • Proposal Agenda: February 7, 2018
  • Publication: February 23, 2018  
  • Public Hearing: March 20, 2018  
  • Public Comment: February 23 until March 26, 2018
  • Adoption Agenda Date: July 25, 2018
  • Deadline for Adoption: August 23, 2018

Bill Subjects:

  • HB 1648, relating to the designation of a water conservation coordinator by a retail public water utility to implement a water conservation plan.
  • HB 3735, relating to an application for a new or amended water right submitted to the Texas Commission on Environmental Quality.
  • SB 864, relating to the procedure for obtaining a right to use state water if the applicant proposes an alternative source of water that is not state water.
  • SB 1430, relating to a requirement that the Texas Commission on Environmental Quality provide an expedited procedure for acting on certain applications for an amendment to a water right by certain applicants that use desalinated seawater.
