State Senator Brandon Creighton, Chair of the Senate Education Committee, sent a request asking for the Attorney General’s Opinion on the Constitutionality of legislation creating a Texas Education Savings Account (ESA) program for Texas children. Texas Attorney General Ken Paxton’s opinion states that Education Savings Account (“ESA”) programs do not violate the Establishment Clause of the First Amendment.
