Sen. Brian Birdwell has requested an opinion from the acting Attorney General Angela Colmenero on whether school boards have the authority to adopt local procedures that would allow uniformed school marshals to carry firearms on their duty belts. He requested the opinion after conversations with superintendents in SD 22. Sen. Birdwell references Education Code Sec. 37.0811(c)(1) & (2) which provides that duly appointed school marshals may carry handguns only “in the manner provided by written regulations adopted by the board of trustees or the governing body” and “at a specific school as specified by the board of trustees or governing body, as applicable.”
