The Texas Education Agency (TEA) has proposed changes to two Commissioner of Education rules.
The first amendment, proposed to 19 TAC Ch. 102, Commissioner’s Rules Concerning Supplemental Special Education Services, would clarify criteria for parent-directed services for students receiving special education services to align with the passage of House Bill (HB) 2 and Senate Bill (SB) 568, 89th Texas Legislature, Regular Session, 2025. The public comment period on the proposal ends December 1, 2025.
The second amendment, proposed to 19 TAC Ch. 103, Commissioner’s Rules Concerning Video Surveillance of Certain Special Education Settings, would replace the term “self-contained classroom” with “special education classroom” and clarify the definitions for classroom settings in accordance with House Bill (HB) 2, 89th Texas Legislature, Regular Session, 2025. The public comment period on the proposal ends December 1, 2025.
Both proposed amendments have an earliest possible date of adoption of November 30, 2025 and a proposed effective date of March 1, 2026. Both proposed amendments were published in the October 31st Edition of the Texas Register.
