  • Chapter 101. Assessment – TEA adopts amendments related to English language learners in state assessments. The adopted amendments aim to align rules with existing state and federal policies regarding the assessment of emergent bilingual students. Amendments include clarification of the definition of EB students and includes they must meet participation requirements to be assessed with the alternate English language proficiency assessment. EB students in Grade 3 or higher are eligible to participate in state academic assessments. EB students must take the English-version state assessment unless the Spanish-version is more appropriate.

  • Chapter 30. Occupational Licenses and Registration – TCEQ proposes amendments aiming to implement HB 1845, HB 2453, and SB 422. Amendments incorporate the operator resiliency training requirements; requires specific courses to be taken to qualify for specific license levels. Requires all applicants for new/renewal licenses to subscribe to the FBI’s fingerprinting to allow the commission to automatically revoke a license/registration upon an individual’s imprisonment following a criminal conviction. Proposes to reduce the number of continuing education credits required to renew the Leaking Petroleum Storage Tank Project Manager license.

  • Chapter 25. Substantive Rules Applicable to Electric Service Providers – Proposes rules concerning registration of virtual currency as required by SB 1292 88(R). Establishes a process for the registration of virtual currency mining facilities in the Electric Reliability Council of Texas (ERCOT) region that demand a large load of interruptible power. The proposed rule would require a registrant to provide information to the commission annually about its virtual currency mining facility’s location, owners, form of business, and demand for electricity. The commission may share the registrants’ information with ERCOT.
