The Texas Health and Human Services Commission (HHSC) will conduct a public hearing on Monday, March 3, 2014, at 9:30 a.m. to receive public comment on proposed payment rates for cognitive rehabilitation therapy in the Home and Community-based Services (HCS) and Community Living Assistance and Support Services (CLASS) waiver programs operated by the Department of Aging and Disability Services. The Texas Health and Human Services Commission (HHSC) will conduct a public hearing to receive comments on the proposed new rules and amendments to existing rules under Title 1, Part 15, Chapters 366, 370, and 375, concerning the implementation of Medicaid and Children’s Health Insurance Program (CHIP) eligibility changes. The purpose of the proposed rules is to amend previously adopted rules implementing federally required income eligibility changes to Medicaid included in section 1902(e)(14) of the Social Security Act (42 U.S.C. § 1396a(e)(14)) and CHIP as required by section 2102(b)(1)(B) of the Social Security Act (42 U.S.C. § 1397bb(b)(1)(B)), and section 2107(e)(1) of the Social Security Act (42 U.S.C. § 1397gg(e)(1)).  The rules, adopted December 13, 2013, changed prior financial eligibility criteria for Medicaid and CHIP to conform to federal law and regulations that are effective January 1, 2014. The proposed rules modify definitions and terms to align the rules with federal laws and regulations and current HHSC policy and processes; restore assets and resource tests for the Medically Needy and the Refugee Medical Assistance programs; allow each CHIP member to select a managed care organization for health and dental coverage based on the service area where they live, rather than making the selection at the family level; modify the CHIP waiting period exemptions to comply with federal rules; and allow a Medicaid recipient denied at renewal for failure to provide information 90 days to submit the requested information without having to submit a new full application. provided through Texas Health Steps Comprehensive Care Program. In September 2012 the Texas State Auditor's Office (SAO) issued a report entitled, "The Health and Human Services Commission's Administration of Home Health Services within the Texas Health Steps Program."  The SAO report provides recommendations to improve program efficiencies and reduce opportunities for fraud and waste. Specific recommendations include strengthening processes for obtaining documentation to establish the need for services. HHSC proposes the rule amendments to align program and medical policy for personal care services provided to individuals under the age of 21 through the Texas Health Steps Comprehensive Care Program.  In addition, proposed rule changes aim to strengthen the documentation process for establishing diagnostic information in line with the SAO recommendations.  The proposal also updates the language to reflect current terminology. Monitor the health advisory panel stemming from HB 3793 (83R). 4. Determine which counties have implemented a cite-and-summons policy, whether the policy has been effective in lessening overcrowding in county jails, and whether those cited by peace officers comply with the policy. 5. Study the implementation of SB 462 (83R). Examine which counties currently have veterans courts, as well as veterans courts in other states, and determine how those programs are working and whether these courts provide additional services or resources for veterans. Make appropriate recommendations. (Joint charge with the House Committee on Defense and Veterans' Affairs) 6. Conduct legislative oversight and monitoring of the agencies and programs under the committee’s jurisdiction and the implementation of relevant legislation passed by the 83rd Legislature. In conducting this oversight, the committee should: a. consider any reforms to state agencies to make them more responsive to Texas taxpayers and citizens; b. identify issues regarding the agency or its governance that may be appropriate to investigate, improve, remedy, or eliminate; c. determine whether an agency is operating in a transparent and efficient manner; and d. identify opportunities to streamline programs and services while maintaining the mission of the agency and its programs.

The Texas Health and Human Services Commission (HHSC) will conduct a public hearing to receive comments on the proposed new rule under Title 1, Part 15, Chapter 354, Subchapter B,  §354.1452, concerning Provider Marketing, and amended rule under Title 1, Part 15, Chapter 353, Subchapter E, §353.405, concerning Marketing.  HHSC proposes new §354.1452 to specify the types of provider marketing that are prohibited as well as those that are considered permissible and to permit providers to submit proposed marketing materials to HHSC for review and prior authorization to ensure that the materials are in compliance with the rule.  HHSC also proposes to amend §353.405 to include a reference to proposed new §354.1452, which will extend the provider marketing activity requirements to providers under Medicaid managed care and Children’s Health Insurance Program (CHIP), clarify that managed care organizations are allowed to assist their existing clients with reapplication, and allow STAR+PLUS providers to educate clients about the availability of long-term care services and supports, if the activities are permitted by the provider's contract. The rules are intended to decrease fraud and improve the client experience.
