Review the net reinsurance premiums, the system's administration expenses, and the incurred losses for the year taking into account investment income and other appropriate gains and losses; G. Review and adjust, if needed, the initial level of benefits and maximum liability limit to be retained by reinsured carriers to reflect increases in costs, and utilization for Small Employer Health Benefit Plans in Texas. Any adjustment will not be less than the annual change in the medical component of the Consumer Price Index for All Urban Consumers' published by the Department of Labor, Bureau of Statistics, unless the board proposes and the commissioner approves a lower adjustment factor; H. Review and determine the system's net loss, if any, for the previous calendar year taking into account investment income and other appropriate gains and losses and prepare the report for submission to the commissioner not later than March 1st, 2016; I. Estimate the amount, if any, of the assessments needed to fund any losses incurred by the system in the previous calendar year and review the report to the commissioner before March 1st. If the estimate exceeds the 5 percent calculation specified in Insurance Code s1501.325(b), then perform the evaluation and prepare the additional report, as specified in s1501.325(b), to submit to the commissioner not later than April 1st. 10. Discussion and possible action on assessment of reinsured carriers by the system. 11. Election of a chair, vice-chair, secretary, and treasurer for the board of directors of the system. 12. Proposed Medicaid Payment Rates for Prescribed Pediatric Extended Care Center Program. Hearing.  Health and Human Services Commission (HHSC) will conduct a public hearing on Feb. 10, 2016, at 9 a.m. to receive public comment on proposed payment rates for the PPECC program operated by HHSC. The hearing will be held in compliance with Texas Human Resources Code §32.0282 (relating to public hearing on rates) and Texas Administrative Code (TAC) Title 1, §355.9080 (relating to general reporting and documentation, methods, and procedures), which require public notice of and hearings on proposed Medicaid reimbursements. Proposal.  HHSC proposes to administer and implement rates and establish a reimbursement methodology for Prescribed Pediatric Extended Care Centers (PPECCs). A PPECC provides non-residential, facility-based care as an alternative to private-duty nursing for individuals under the age of 21 with complex medical needs. In accordance with Texas Human Resources Code section 32.024(jj), HHSC is establishing PPECCs as a separate Medicaid provider type.  The proposed rates will be effective Feb. 15, 2016. Methodology and Justification.  HHSC calculated the proposed payment rates in accordance with the rate-setting methodologies codified in the TAC Title 1, §355.9060 (relating to reimbursement methodology for the Youth Empowerment Services waiver program). The rules are being amended for two reasons. The first is to outline the ability of a hospital to request its underlying data used in the analysis that determines penalties and incentive payments. The proposed amendments specify the additional information a hospital can expect in the underlying data, including readmission data on other hospitals. The second reason is to identify a methodology for incentives for HHSC-defined safety-net hospitals. This is pursuant to House Bill 1, 84th Legislature, Regular Session, 2015 (Article II, Special Provisions Section 59(b)), which directs HHSC to provide incentive payments to safety-net hospitals in the amount of $150,378,593 (all funds) in fiscal year 2016 and $148,641,716 (all funds) in fiscal year 2017. It specifies that HHSC establish a program to use ten percent of these additionally appropriated funds to distribute to these hospitals based on quality metrics. Total reimbursement for each hospital must not exceed its hospital specific limit. However, HHSC will expend ten percent of these funds to provide additional increases to safety-net hospitals above which exceed existing quality metrics, which may result in exceeding the hospital specific limit. To the extent possible, HHSC will ensure that any funds included in Medicaid managed care capitation rates are distributed by the managed care organizations to the hospitals. Nursing Facility Minimum Payment Amounts Program Transition.* HHSC proposes amendments to Title 1, Part 15, Chapter 353, Subchapter G, s353.608, concerning Minimum Payment Amounts to Qualified Nursing Facilities. During the 84th Session, the Texas Legislature, through the 2016-17 General Appropriations Act, directed HHSC to transition the Nursing Facility Minimum Payment Amounts Program (MPAP) from a program solely based on enhanced payment rates to publically owned nursing facilities to a Quality Incentive Payment Program (QIPP) for all nursing facilities that have a source of public funding for the non-federal share. (H.B 1, 84th Legislature, Regular Session, 2015, Article II, Health and Human Services Commission, Rider 97). The additional payments to nursing facilities through the QIPP are to be based on improvements in quality and innovation in the provision of nursing facility services. The proposed amendments to s353.608 allow a transition period for existing MPAP participants to make the shift to QIPP. In this transition period, current MPAP participants will be allowed to continue receiving MPAP payments at approximately 50 percent of their current MPAP payment level. Facilities not currently enrolled in MPAP will not be eligible for transition MPAP payments. Proposed new s353.609, concerning Quality Incentive Payment Program for Nursing Facilities, describes the QIPP. – Pam McDonald, Director of Rate Analysis, HHSC 5. Quality Incentive Payment Program for Nursing Facilities.* HHSC proposes new s353.609 under Texas Administrative Code Title 1, Part 15, Chapter 353, Subchapter G (concerning STAR+PLUS). The 2016-2017 General Appropriations Act, directs HHSC to create the Quality Incentive Payment Program (QIPP) no later than September 1, 2016. (H.B. 1, 84th Legislature, Regular Session, 2015, Article II, Health and Human Services Commission, Rider 97, at II-107). As per Rider 97, QIPP will be open to all nursing facilities that have a source of public funding for the non-federal share and additional payments to nursing facilities are to be based upon improvements in quality and innovation in the provision of nursing facility services, including, but not limited to: establishing culture change, small house models, staffing enhancements, and outcome measures to improve the quality of care and life for nursing facility residents. QIPP will allow for incentive payments to nursing facilities that meet metrics that are previously agreed upon between a nursing facility and an MCO and approved by HHSC. The QIPP projects must meet certain goals of the program as described by HHSC. The QIPP payment will be made by the MCO in accordance with the agreement between the MCO and the nursing facility. – Pam McDonald, Director of Rate Analysis, HHSC 6. Potentially Preventable Readmissions and Potentially Preventable Complications.* HHSC proposes to amend Texas Administrative Code Title 1, Part 15, Chapter 354, Subchapter A, Division 35, s354.1445 (relating to Potentially Preventable Readmissions) and s354.1446 (relating to Potentially Preventable Complications). Provider Enrollment.* HHSC proposes amendments to Texas Administrative Code Title 1 Part 15, Chapter 352, s352.3, concerning Definitions; s352.7, concerning Applying for Enrollment; s352.9, concerning Screening Levels; and s352.21, concerning Duty to Report Changes. Providers enrolled in Texas Medicaid and Medicare historically have been able to submit new location information using Provider Information Change (PIC) forms alone. Rule s352.7, however, currently requires providers to submit a completed enrollment application for each practice location. The use of PIC forms to add practice locations is allowable under federal and state law and in alignment with federal direction that state Medicaid programs can access the CMS enrollment system to verify provider location information. To ensure practice locations are enrolled in compliance with state and federal rules, while limiting the administrative burden for providers, these amendments revise rule provisions to require one enrollment application for each provider, then leverage available Medicare data to ensure practice locations not included in the initial enrollment application are screened and validated. PIC forms, in lieu of a complete new application, will be accepted for limited-risk Medicaid providers and providers enrolled in both Medicaid and Medicare to update their practice locations. – Laurie Vanhoose, Director of Policy, Medicaid/CHIP – HHSC 8. Sampling and Extrapolation.* HHSC proposes new Texas Administrative Code Title 1, Part 15, Chapter 371, Subchapter B, s371.19, concerning Sampling and Extrapolation. Senate Bill (S.B.) 207 (84th Legislature, Regular Session, 2015) amended various provisions in Texas Government Code Chapter 531 related to the Office of Inspector General's (OIG's) authority and duties. Among other things, the bill requires that the OIG review its process of sampling and extrapolation, and requires the OIG to use generally-accepted standards related to sampling and extrapolation in audits and investigations. Proposed new s371.19 implements these requirements. – Anne Dvorak, Senior Counsel for Audit – HHSC-OIG notice of proposed rules / action items: 9. Rules for the HHSC OIG.* HHSC proposes amendments to Texas Administrative Code Title 1, Part 15, Chapter 371, Subchapter A, s371.1, concerning Definitions; Subchapter E, s371.1005, concerning Disclosure Requirements; s371.1009, concerning Verifications Required for Each Screening Level; s371.1011, concerning Recommendation Criteria; and s371.1015, concerning Types of Provider Enrollment Recommendations. S.B. 207 (84th Legislature, Regular Session, 2015) amended various provisions in Texas Government Code Chapter 531 related to the OIG's authority and duties. S.B. 207 requires the adoption of rules that outline the criminal history record information, by provider type, that could result in exclusion of a person from Medicaid as a provider. The bill also prohibits the OIG from conducting a criminal history record check on providers whose licensing authority already requires the submission of fingerprints for criminal background checks, unless the check is required or appropriate for other reasons such as a fraud, waste, or abuse investigation. The proposed amendments to s371.1011 implement these requirements. Additional clarifications to the provider enrollment and screening rules are proposed in response to the reassignment of the on-site inspection function to the HHSC Medicaid/CHIP Division and in response to guidance issued by the Centers for Medicare & Medicaid Services (CMS), specifically, that states may rely upon on-site inspection visits performed by CMS in lieu of conducting redundant independent visits for some providers. The proposed amendments also include clarifications and deletion of obsolete provisions in the definitions section. Specifically: Proposed s371.1 is amended to include a definition for "enrollment" and to delete the definitions for "probationary contract" and "provisional contract." The OIG will no longer enroll providers on a probationary or provisional basis. Proposed s371.1005 is amended to clarify that both providers and provider's employees are subject to disclosure requirements and review. Proposed s371.1009 is amended to reflect that the OIG no longer conducts site visits. This function is instead handled by HHSC's Medicaid/CHIP division. Proposed s371.1015 changes a reference from 20 calendar days to 20 business days to allow providers more time to file for reviews of denied applications. – Anne Dvorak, Senior Counsel for Audit – HHSC, Office of Inspector General 10. School Health and Related Services (SHARS) Program Conditions for Participation.* HHSC proposes amendments to Texas Administrative Code Title 1, Part 15, Chapter 354, Subchapter A, Division 25, s354.1342, concerning Conditions for Participation. The proposed rule amendment requires school districts to bill for services at the time the services are delivered and requires billing for each cost category if the district will seek reimbursement for that category through their annual cost report. – Nadia Bobb, Rate Analyst, HHSC Rate Analysis for Acute Care Services 11. Youth Empowerment Services (YES) Waiver amendment.* The Department of State Health Services (DSHS) proposes to amend Texas Administrative Code Title 25, Part 1, Chapter 419 (relating to Mental Health Services Medicaid State Operating Agency Responsibilities), Subchapter A (relating to Youth Empowerment Services (YES)), 419.1-419.8. The YES Waiver provides comprehensive home and community-based mental health services to children, ages 3 through 18, up to a child's 19th birthday, at risk of institutionalization and/or out-of-home placement due to their serious emotional disturbance. A child who is interested in the YES program is placed on an inquiry list by the local mental health authority (LMHA) on a first-come, first-served basis. Due to the statewide expansion of YES in 2015 and the expected inclusion of foster care children in 2016, it is anticipated that the number of children who will be placed on an LMHA inquiry list will increase significantly. The proposed amended rules will direct the maintenance and prioritization of children on the inquiry list. The proposed amended rules will require that children who are at imminent risk of relinquishment to the state be prioritized on the YES Waiver inquiry list, and will align with an amendment to the YES Waiver being submitted to CMS, as well as with program policy. It is anticipated that prioritizing this population will reduce the number of children with serious emotional disturbances placed in conservatorship of the state. – Trina Ita, Director, Program Services Section II, Department of State Health Services 12. State Children's Health Insurance Program Enrollment.* HHSC proposes to amend Texas Administrative Code Title 1, Part 15, Chapter 370, Subchapter C, Division 1, s370.303, concerning Completion of Enrollment, to include consideration of a CHIP applicant's managed care history in the algorithm used to assign a managed care organization (MCO) when the applicant has not made a selection. The proposed change is intended to improve continuity of care. HHSC proposes to amend this rule to include requirements for completion of enrollment when a Medicaid member transitions to CHIP after being determined ineligible for Medicaid, including paying any applicable enrollment fees. The proposed rule change will allow children in these circumstances to be enrolled in CHIP prior to paying any applicable enrollment fees, eliminating gaps in coverage. In addition to these changes, HHSC proposes to amend this rule to clarify that an applicant must pay an enrollment fee, if one is due, to complete CHIP enrollment. Current Medicaid processes require CHIP applicants to pay applicable enrollment fees prior to enrollment, so the addition of this requirement to the rule is only for clarification and consistency. – Michelle Erwin, Manager, Program Management, HHSC Medicaid/CHIP 13. Medicaid Managed Care.* HHSC proposes amendments to Texas Administrative Code Title 1, Part 15, Chapter 353, Subchapter A, s353.2, concerning Definitions; and s353.4, concerning Managed Care Organization Requirements Concerning Out-of- Network Providers. HHSC also proposes amendments to Title 1, Part 15, Chapter 353, Subchapter E, s353.411, concerning Accessibility of Services. HHSC proposes new Title 1, Part 15, Chapter 353, Subchapter E, s353.423, concerning Expedited Credentialing. House Bill (H.B.) 1878 (84th Legislature, Regular Session, 2015) requires HHSC to reimburse Medicaid providers for school-based telemedicine services. Amended s353.4 implements these statutory requirements. S.B. 760 (84th Legislature, Regular Session, 2015) requires HHSC to implement several network adequacy initiatives. Specifically, S.B. 760 enacted Texas Government Code s533.0061, which requires HHSC to establish minimum access standards for specific services. S.B. 760 also enacted Texas Government Code s533.0064, which requires HHSC to establish and implement an expedited credentialing process that would allow providers to provide services to recipients on a provisional basis. The proposed changes to s353.411 address the network adequacy requirements, while proposed new s353.423 addresses expedited credentialing. – Emily Zalkovsky, Director, Medicaid/CHIP Program Management, HHSC 14. HHSC Advisory Committees.* HHSC proposes new Subchapter B, concerning Advisory Committees, under Texas Administrative Code Title 1, Part 15, Chapter 351, Coordinated Planning and Delivery of Health and Human Services. HHSC also proposes the repeal of s351.3, concerning Purpose, Task and Duration of Advisory Committees. S.B. 200 and S.B. 277 (84th Legislature, Regular Session, 2015) removed 38 advisory committees from statute and authorized the HHSC Executive Commissioner to reestablish committees in rule. As part of implementing this directive, the ongoing need for each advisory committee was evaluated and stakeholder feedback was requested. After the HHSC Executive Commissioner reviewed this information and made final decisions, HHSC published a list of committees that were either consolidated in some way, continued as they are currently, or discontinued. The list of committees that will be continued was posted in the Texas Register on October 30, 2015. Identify opportunities for improved collaboration to promote healthy aging in the health and human services system at the state, regional and local levels; Examine and recommend ways to improve quality and oversight in long-term care settings, including nursing homes and ICF/HCS programs. Monitor the implementation of legislation addressed by the Senate Committee on Health and Human Services during the 84th Regular Session related to the revocation of nursing home licenses for repeated serious violations; and Examine the cause of action known as “wrongful birth.” The study should examine (1) its history in Texas, (2) its effect on the practice of medicine, and (3) its effect on children with disabilities and their families. Health and Human Services Commission (HHSC) will hold information sessions at locations around the state in January and Feb. of 2016 related to the transition of various Medicaid services to the STAR Kids program. Beginning Nov. 1, 2016, the STAR Kids managed care program will provide Medicaid benefits to individuals with disabilities under the age of 21 who receive Supplemental Security Income Medicaid or are enrolled in home and community-based services waiver programs, including: Medically Dependent Children Program, Home and Community-based Services, Community Living Assistance and Support Services, Deaf Blind with Multiple Disabilities, Texas Home Living and Youth Empowerment Services. Proposed Medicaid Payment Rates for Supported Employment and Employment Assistance for the Youth Empowerment Services Waiver Program. Hearing.  Health and Human Services Commission (HHSC) will conduct a public hearing on Feb. 23, 2016, at 9 a.m. to receive public comment on proposed revised payment rates for the Youth Empowerment Services (YES) waiver program operated by the Department of State Health Services. The hearing notice represents a revised notice of a hearing previously scheduled for Jan. 21, 2016, and posted on the HHSC website on Dec. 23, 2015. The rate hearing has been rescheduled as indicated above with a revised proposed effective date. The hearing will be held in compliance with Texas Human Resources Code §32.0282 (relating to public hearing on rates) and Texas Administrative Code (TAC) Title 1, §355.105(g) (relating to general reporting and documentation, methods, and procedures), which require public notice of and hearings on proposed Medicaid reimbursements. Proposal.  HHSC proposes to revise payment rates for Supported Employment and Employment Assistance services for the YES waiver program from an hourly rate to a fifteen minute rate.  The proposed rates will be effective March 15, 2016. Methodology and Justification. HHSC calculated the proposed payment rates in accordance with the rate setting methodologies codified in the TAC Title 1, §355.9060 (relating to reimbursement methodology for the YES waiver program).
