STAR+PLUS Provider Training. On September 1, 2014, the STAR+PLUS Medicaid managed care program will expand statewide to the rural service areas of Texas (Central, Northeast, and West).  People who are age 65 or older or who have disabilities and are covered by Medicaid will begin receiving services through a STAR+PLUS managed care health plan.  The Health and Human Services Commission (HHSC) is holding provider trainings across the three rural service areas to educate providers on STAR+PLUS managed care and what changes to expect. The Central rural service area managed care organizations will be present to answer questions. Following the 9 a.m. STAR+PLUS Provider Training, another training for providers who serve people with intellectual and developmental disabilities will be held in the same room. Discussion and recommendation for Board concerning harmonizing specialities as described under Rule 71.15 (including deletion of the rule) and Rules 77.2 concerning publicity and 77.5 concerning misleading terms with the Chiropractic Act. 17. Discussion and recommendation for Board concerning procedures and guidelines for handling patient records after the death of a chiropractor and/or facility owner. 18. Discussion and recommendation for Board concerning a recommendation from Board staff to modify Rule 75.13 to clarify that disciplinary aspects for written reprimands and adding language to clarify that administrative penalty is a disciplinary action 19. Hearing.  The Texas Health and Human Services Commission (HHSC) will conduct a public hearing on August 7, 2014, at 8:00 a.m. to receive public comment on proposed base rate increases for attendant services provided under the following programs operated by the Department of Aging and Disability Services (DADS): Primary Home Care; Community Attendant Services; Family Care; Community Based Alternatives – Home and Community Support Services; Residential Care; Day Activity and Health Services; Medically Dependent Children Program; and Consumer Directed Services. The hearing will be held in compliance with Texas Human Resources Code §32.0282 and Texas Administrative Code (TAC) Title 1, §355.105(g), which require that public hearings be held on proposed reimbursement rates before such rates are approved by HHSC.  Proposal.  HHSC proposes to increase the base rates for Primary Home Care, Community Attendant Services, and Family Care Non-Priority Personal Attendant Services; Community Based Alternatives – Home and Community Support Services, Personal Assistance Services, Day Activity and Health Services; Residential Care; Medical Dependent Children Program Attendant Services; and all associated Consumer Directed Services.  The proposed rates will be effective September 1, 2014 and were determined in accordance with the rate setting methodologies listed below under “Methodology and Justification.” Methodology and Justification.  The proposed payment rates incorporate provisions in the 2014-15 General Appropriations Act that included funds to support increases in the base wages of personal attendants to $7.50 per hour in fiscal year 2014 and $7.86 per hour in fiscal year 2015. Proposed Medicaid Nursing Facility and Hospice-Nursing Facility Payment Rates. Hearing.  The Texas Health and Human Services Commission (HHSC) will conduct a public hearing on Thursday, August 7, 2014, at 9 a.m. to receive public comment on Nursing Facility and Hospice-NF Medicaid payment rates.  The hearing will be held in compliance with Human Resources Code §32.0282; Title 1 of the Texas Administrative Code ("TAC"), Part 15, Chapter 355, Subchapter B, §355.201 (relating to Establishment and Adjustment of Reimbursement Rates by the Health and Human Services Commission); and Title 1 of the TAC, Part 15, Chapter 355, Subchapter A, §355.105(g) (relating to General Reporting and Documentation Requirements, Methods and Procedures), which require public notice and a hearing on proposed Medicaid reimbursements.  Proposal.  HHSC proposes to increase NF and Hospice-NF payment rates by six percent as compared to rates in effect on August 31, 2013.  The proposed new rates will be effective September 1, 2014, and were determined in accordance with the rate setting methodologies listed below under “Methodology and Justification.” Methodology and Justification.  The proposed Medicaid payment rates incorporate appropriations provisions from the 2014-15 General Appropriations Act, S.B. 1, 83rd Legislature Regular Session, 2013 (Article II, Department of Aging and Disability Services, Rider 40), which appropriated funds to provide for a six percent increase for NF and Hospice-NF payment rates, calculated based on the rates in effect on August 31, 2013. HHSC’s proposed payment rates were calculated in accordance with the rate setting methodology in Title 1 of the TAC, Part 15, Chapter 355, Subchapter C, §355.307 (relating to Reimbursement Setting Methodology); §355.308 (relating to Direct Care Staff Rate Component); and §355.312 (relating to Reimbursement Setting Methodology – Liability Insurance Costs). These rates and associated minute requirements were subsequently adjusted in accordance with Title 1 of the TAC, Part 15, Chapter 355, Subchapter A, §355.101 (relating to Introduction); and §355.109 (relating to Adjusting Reimbursement When New Legislation, Regulations or Economic Factors Affect Costs); and, Title 1 of the TAC, Part 15, Chapter 355, Subchapter B, §355.201 (relating to Establishment and Adjustment of Reimbursement Rates by the Health and Human Services Commission). Proposed Medicaid Payment Rate for Truman W. Smith Children’s Care Center. Hearing.  The Texas Health and Human Services Commission (HHSC) will conduct a public hearing on Thursday, August 7, 2014, at 10:30 a.m. to receive public comment on the proposed rate for the Truman W. Smith Children’s Care Center, a nursing facility that is a member of the pediatric care facility special reimbursement class of the Nursing Facility Program operated by the Texas Department of Aging and Disability Services.  The hearing will be held in compliance with Texas Human Resources Code §32.0282 and Texas Administrative Code (TAC) Title 1, §355.105(g), which require public notice and hearings on proposed Medicaid reimbursements before such rates are approved by HHSC.  Proposal.  HHSC proposes to increase the rate for the nursing facility pediatric care facility special reimbursement class for Truman W. Large State-Operated ICF/IID Facilities – Medicaid Only clients Proposed interim daily rate:  $770.11. Large State-Operated ICF/IID Facilities – Dual-eligible Medicaid/Medicare clients Proposed interim daily rate:  $747.69.
