At a hearing in Pensacola, Fla. held on September 14th, U.S. District Judge Roger Vinson indicated he would let the case proceed to a trial. However, the judge may also throw some parts of the case out. He’s expected to issue a ruling by October 14th.

 

A bipartisan coalition of 20 state attorneys generals and governors are challenging the constitutionality of the Patient Protection and Affordable Care Act, including the Texas State Attorney General.

 

During the hearing, the states urged the court to reject the U.S. Department of Justice’s motion to dismiss their case. Last month, a federal judge in Virginia rejected a similar attempt by the federal government when the court denied the DOJ’s motion to dismiss the Commonwealth of Virginia’s challenge.
